Prosecutor (#021905) Criminal Prosecution Division, Columbia (RICHLAND)

Job Responsibilities

• Prosecutes criminal cases containing a SCDC nexus before the SC state grand jury and in all judicial circuits throughout the state upon approval by the South Carolina Attorney General's Office.
• Authorizes prosecution based on a memorandum of understanding between SCDC and the AG's office.
• Manages a personal caseload of cases for prosecution.
• Affords legal advice to special agents on search warrants, evidence, and future legal issues.
• Assists in determining documentation to be released to FOIA, subpoenas, rule 5, etc.
• Presents documents and other information to defendants or their lawyers, upon request and as required by law, on cases actively being prosecuted by the Criminal Prosecution Division.
• Available to respond after hours in person or by phone to serious crime scenes and emergencies to provide legal advice.
• Researches legal issues, prepares briefs and oral arguments.
• Updates the Division Director and appropriate department staff on recent changes in state and federal law.
• Serves as a liaison between the Solicitor’s offices around the state, the AG’s office, attorneys representing individuals in criminal cases, etc.
• Responds to correspondence from attorneys, court officials, state agencies regarding SCDC criminal cases.
• Provides legal advice on criminal matters to the Director, Senior Executive Staff, and other agency personnel in matters of state and federal law.
• Provides agency personnel with education and guidance in areas related to criminal issues during in-service training and other forums as directed.
• Aids in drafting legislation and regulations.
• When required, presents information to members of the general assembly, state or federal agencies, or constituency representatives.

Requirements

• A juris doctor degree or its equivalent from an accredited law school and experience as a practicing attorney.
• At least two (2) years of experience as a practicing attorney.
• A member and in good standing with the South Carolina bar.
• Satisfied the 403 Requirements.

Preferred Qualifications

• Prosecutorial experience preferred.
