Responsibilities
- Support the day-to-day management of patent litigation matters in U.S. federal courts, PTAB proceedings, and, as needed, ITC Section 337 investigations.
- Support day-to-day management of trademark and copyright litigation.
- Draft motions and briefs, including discovery motions, claim construction (Markman) briefing, Daubert motions, and dispositive motions, with opportunities to argue in court as appropriate.
- Take and defend depositions of fact witnesses and assist in preparing inventors, experts, and corporate representatives for testimony.
- Aid in fact and expert discovery, including document review, ESI protocols, drafting protective orders, and coordination with vendors.
- Contribute to infringement and invalidity analyses; assist with preparation and refinement of contentions and collaborate with technical and damages experts.
- Support trial preparation, including drafting witness outlines, preparing exhibits, assisting with motions in limine and jury instructions, and providing in-court support.
- Collaborate with experts on damages analyses and support broader case strategy, including settlement discussions.
- Communicate effectively with internal teams and contribute to client reporting and case strategy discussions.
- Collaborate with partners, senior associates, and professional staff; provide guidance to junior team members and contribute to a positive team environment.
Qualifications
- JD from an accredited law school with strong academic credentials.
- 3–5 years of intellectual property litigation experience at an AmLaw 200 firm or leading IP boutique.
- Experience with key phases of intellectual property litigation, including pleadings, discovery, depositions, expert discovery, claim construction, dispositive motions, and trial preparation.
- Experience drafting substantive motions and briefs; deposition and oral advocacy experience preferred.
- Technical background (e.g., electrical engineering, computer science, mechanical engineering, physics, biology, chemistry) preferred; USPTO registration a plus.
- Experience with PTAB IPRs and/or ITC Section 337 investigations is a plus.
- Experience with TTAB oppositions, cancellations, and/or appeals is a plus.
- Experience with UDPR complaints is a plus.
- Familiarity with FRCP, FRE, patent local rules, and e-discovery tools/practices.
- Strong legal writing, research, and analytical skills, with attention to detail and sound judgment.
- Strong organizational skills and ability to manage multiple assignments and deadlines in a fast-paced environment.
- Demonstrated ability to work collaboratively as part of a team.
- Active bar admission in the relevant jurisdiction or ability to obtain admission by waiver.
Hours Expectations & Compensation
- Expectations: 1,800 billable hours and an “all-in” hours expectation of 2,050 or 2,150, depending on seniority.
- Compensation Range: $193,000 - $280,000, inclusive of salaries in all listed markets.
- To be eligible for a bonus, associates must reach or exceed 1,850 billable hours (inclusive of up to 50 pro bono hours) and meet or exceed the all-in hours expectation.
