Job Responsibilities
The South Carolina Department of Motor Vehicles (SCDMV) is seeking a business-minded, execution-driven, attorney to help formulate agency legal strategies. This position is in the Office of General Counsel, at SCDMV Headquarters in Blythewood, SC.
- Works closely with various divisions and offices to identify legal problems and guides establishment of operating procedures, especially in regard to contracts and procurement.
- Advises agency employees regarding contracts, procurement, and data security issues.
- Provides legal counsel to financial responsibility office on approval and monitoring of self-insured companies, including litigation as needed.
- Provides legal counsel to the Office of Inspector General regarding vehicle dealer and driver training school regulation; litigates cases and appeals.
- Responds to legal inquiries from the public and from other government agencies, especially in regard to contracts, procurement, bankruptcy, probate, and trust issues.
- Advises employees on policy and operating procedures resulting from the enactment or amendment of legislation, regulations and court decisions.
- Works with Office of Training and Change Management to create training materials; conducts training as needed.
- Prepares memoranda, briefs, and/or proposed orders in the context of court cases and administrative appeals.
- Researches and prepares legal opinions for use of department employees.
- Represents the department in litigation, including actions in the Office of Motor Vehicle Hearings, the Administrative Law Court, and other state trial and appellate courts, as assigned.
- Secondary attorney for titles, taxes, road use fees (RUF), infrastructure maintenance fees (IMF), IFTA, IRP, personnel, and driver’s license issues.
Minimum Requirements
- A juris doctor degree or its equivalent from an accredited law school and experience as a practicing attorney.
- A minimum of five years' experience as a practicing attorney.
- Must have Rule 403 Requirements, S.C. Appellate Court Rules.
Additional Requirements
- Membership in the South Carolina Bar and licensed to practice law in the state and federal courts of South Carolina.
- Must be knowledgeable of pertinent state and federal laws and regulations, administrative rulings and procedures, and rules of court.
- Good organization skills and ability to work independently.
- Ability to communicate effectively orally and in writing; interpret and apply laws and judicial decisions.
- General knowledge of statutory and regulatory schemes involving motor vehicle-related issues.
Agency Preferred
- Trial experience and appellate practice preferable.
