About the role
Join the State of Connecticut, Department of Public Health (DPH) as a Staff Attorney 2 to help ensure public health and safety in our state. This position involves reviewing, negotiating, and presenting cases involving licensed healthcare entities, with a significant impact on the quality of health care in Connecticut.
You will support the Certificate of Need (CON) program, which regulates specific healthcare facilities and services to ensure access to quality and cost-effective healthcare for Connecticut residents and to avoid unnecessary duplication of those facilities and services.
Position details: Location: 410 Capitol Avenue, Hartford, CT. Work Schedule: Monday–Friday, full-time, first shift, 40 hours per week, 8:00am–4:30pm.
Responsibilities
- Review CON applications and submissions
- Conduct legal research
- Hold public hearings as a Hearing Officer
- Draft CON determinations and CON decisions
- Oversee compliance for legal issues
- Participate in working groups
- Interact with hospital administrators, stakeholders, and members of the public verbally and in writing
- Provide information and advice to DPH leadership as required
In this job class you will independently perform a full range of tasks in the legal work of the agency, including:
- Perform advanced and complex legal work of an agency
- Research, interpret, analyze, and apply complex and conflicting laws and regulations, case law, and legal principles
- Act as hearing officer or represent the agency in formal administrative and public proceedings on a full range of cases involving complex legal and technical issues
- Negotiate and draft settlement agreements
- Draft advisory opinions, rulings, decisions, recommendations, findings, legislation, statutes, regulations, publications, and other related legal documents
- Assist in the preparation and presentation of trials and appeals
- Consult with the Office of the Attorney General on legal issues
- Conduct investigations and enforcement proceedings
- Prepare comprehensive reports for use in administrative and court proceedings
- Prepare pleadings and other court papers
- Participate in the conduct of various educational activities
- Provide legal guidance when duly authorized
- Provide input into policy formation
- Review court decisions, new and proposed laws and regulations to determine impact on agency operations
- Prepare and maintain precedent manuals
- Review legal and other related documents for legal sufficiency
- May testify at or monitor legislative proceedings
- May represent the agency in court when authorized
- Perform related duties as required
Knowledge, Skills, and Abilities
- Considerable knowledge of legal principles, practices, and procedures in Connecticut
- Knowledge of legal research techniques
- Knowledge of the Uniform Administrative Procedures Act
- Ability to interpret and apply relevant state and federal laws, statutes, regulations, and legislation
- Knowledge of relevant agency policies and procedures
- Knowledge of the rules of evidence, criminal and constitutional law, and the legislative process
- Considerable interpersonal skills
- Oral and written communication skills
- Considerable ability to apply judicial decisions to the interpretation of statutes
- Ability to comprehend, analyze, and organize technical data and coordinate elements of legal cases
Minimum Qualifications
Two (2) years of experience in the practice of law.
Preferred Qualifications
- Civil litigation or administrative hearing experience
- Experience drafting contractual instruments
- Experience negotiating complex settlements
- Experience working within a team to manage projects and meet deadlines
- Experience working with health care providers and other members of the healthcare community
Special Requirements
- Incumbents in this class must be admitted to practice law in the State of Connecticut.
- Incumbents in this class may be required to travel.
