Return to Work in the age of COVID-19

As employers and employees return to work, the environment will differ significantly from the pre-COVID-19 world. Under Governor Polis’ Safer At Home Executive Order D 2020 044, employers are directed to:

• Accommodate workers with childcare responsibilities and those living with vulnerable individuals by promoting telecommuting, flexible schedules, or other remote work options.
• Prevent workplace discrimination related to COVID-19, providing reasonable accommodations and prohibiting discrimination against employees showing symptoms or exposed to positive cases.
• Ensure all critical businesses operate with mandatory social distancing and cleaning protocols.
• Permit non-critical commercial businesses to allow up to 50% of employees to work in-person (outside private residences) under social distancing and safety protocols, effective May 4, 2020.
