Regulatory Advisor - Certified Community Behavioral Health Clinic

This position will be paid biweekly. About the position:

• Serves as the definitive Behavioral Health Administration (BHA) Subject Matter Expert (SME) and primary point of contact (POC) for all regulatory projects, policy determinations, and processes related to the CCBHC Demonstration pilot.
• Leads and tracks the progress of CCBHC regulatory initiatives from initial concept through federal approval, implementation, and final publication.
• Acts as a critical inter-agency bridge and central collaborator linking internal BHA divisions (Licensing, Policy, and Data) with external health system partners, including HCPF, BHASO partners, Regional Accountable Entities (RAEs), the Attorney General’s Office, federal partners, and the Carina Health Network to ensure strict compliance with federal SAMHSA criteria and fiscal data standards.
• Covers the State CCBHC Advisory Board governance, including material development, data evaluations, compliance metric tracking, and federal reporting.
• Conducts annual reviews of the CCBHC demonstration processes and provides synthesized data, analysis, and recommendations to the Director of Regulatory Affairs to shape BHA's annual Regulatory and Policy Agenda.

Behavioral Health Rules Drafting and Technical Assistance

• Conducts research, analysis and synthesis of best practices for regulatory projects.
• Drafts rules, sub-regulatory guidance, and policies based on established theory and standards of care.
• Develops training and technical assistance materials to support other state agencies, external partners and internal BHA personnel with interpretation and implementation of regulatory projects.
• Supports monitoring of compliance with regulatory projects and CCBHC standards as directed by the Director of Regulatory Affairs.
• Lead development of materials for regulatory projects and any research or additional materials to support justification for Division appearance to the State Board related to projects including CCHBC.
• Creates briefs and provides presentations on how the CCBHC Demonstration affects BHA, other state Departments, and other community partners upon request.
• Makes revisions to regulatory projects based on feedback from the Board and ensures that content expertise is present as needed.
• Maintains the calendar of rule review and revision for the BHA, schedules and manages material development for stakeholder feedback, prepares rule packages, summarizes committee reviews and clearance processes, and ensures all public notice requirements are met.
• Coordinates with the State Board of Human Services Administrator to ensure rule packet completions and coordinates scheduling with the State Board of Human Services.
• Seeks out content expertise both within and outside the BHA and drafting Rule to satisfy a variety of stakeholders and best practices.
• Develops and leads routine meetings and processes for working with other state agencies on regulatory project development to support integrated and consistent regulation across agencies on CCBHC and other related topics across the agency.
• Reviews statutes to ascertain legislative intent and prepare materials for Director of Regulatory Affairs interpretation on intent in rule, including how it connects/affects CCBHC Demonstration, seeking consultation from the Office of the Attorney General as needed.
• Ensures that rules are aligned with other state Departments, including CDPHE licensing rule and DORA scope of practice rule.
• Provides training for stakeholders and BHA staff in regulatory provisions affecting BHA.
• Drafts responses to questions from State Board of Human Services on rationale and content of rule.

Minimum Qualifications, Substitutions, Conditions of Employment & Appeal Rights

• Experience Only: Seven (7) years of relevant experience in regulatory drafting and compliance, federal healthcare program knowledge, and/or inter-agency stakeholder collaboration.
• Or Education and Experience: A combination of related education in Public Policy/Public Administration, Healthcare Administration/Public Health, Law (JD) and/or Social Work/Behavioral Health Administration and/or relevant experience in regulatory drafting and compliance, federal healthcare program knowledge and/or inter-agency stakeholder collaboration.
