About the Position

The Colorado Department of Transportation (CDOT) has a vacancy for an Employee Relations and Civil Rights Manager in our Pueblo location, which oversees 14 counties in Southeastern Colorado. This position manages and administers employee relations and civil rights program activities including but not limited to: Americans with Disabilities Act (ADA); the Family Medical Leave Act (FMLA); Title VI and VII of the Civil Rights Act; Disadvantaged Business Enterprises (DBE) Regional Program Objectives, in accordance with 49 CFR 23, enforcement of regulations and initiation of sanctions for non-compliance Davis-Bacon wages/benefits compliance; contractor On-the-Job Training and other applicable federal regulations on construction projects and anti-discrimination programs. This position also ensures compliance with federal, state and EEO/AA (equal employment opportunity/affirmative action) statutes, rules and directives, as applied to personnel actions and ensure compliance with CDOT Policy and Procedural Directives that involve employee relations or civil rights issues.

Responsibilities

Your duties and responsibilities will include, but are not limited to, the following:

  • Guide, consult, and provide technical expertise and advice to Region top level management for employment actions and approaches, including, corrective actions, disciplinary actions, and grievances
  • Collaborate with CDOT Risk Management to ensure modified duty, workers compensation, ADA, FMLA, and short-term disability are coordinated
  • Resolve disputes on behalf of and with direction from the Region Director
  • Provide technical expertise to Region Director with disciplinary proceedings to assure non-discrimination and consistent outcomes
  • Listen to employees and managers on various concerns or issues that may arise
  • Report new and ongoing employee issues to Region Director and make recommendations to address issues
  • Investigate employee complaints of workplace violence, harassment, discrimination, and unfair employment practices
  • Create unbiased reports of all investigations
  • Respond to interrogatories and other requests from Attorney General's (AG) office, and other federal level agencies such as (EEOC, USDOL and CCRD); consult with AG's office on potential litigation and assists in defense
  • Provide technical advice and guidance to ensure that equal opportunity is afforded to CDOT employees as well as consultants, and contractors who have an interest in or are working on CDOT projects
  • Determine underutilized classes in the workforce; consult with management on specific actions or strategies to increase workforce representation
  • Develop and ensure processes utilized are in compliance with complex federal, state, and CDOT Equal Opportunity and labor laws, rules and policies pertaining to highway construction projects
  • Ensure compliance with Equal Opportunity/Affirmative Action Special Provisions, Federal Highway Administration (FHWA) 1273 and other applicable federal regulations on construction projects
  • Ensure compliance with labor laws and regulations on transportation project sites
  • Provide technical assistance to DBE and Emerging Small Business (ESB) firms
  • Provide high level regional perspective as part of the Region Management Team to help set direction, attend region events, build relationships, and be involved in regional activities
  • Supervise and coach employees, create work plan, develop and give performance reviews, and approve leave requests
  • Other job duties as assigned

Work Environment

  • Primarily 8:00 am – 5:00 pm work hours, Monday-Friday
  • Approximately 20% spent in the field, 80% spent in the office
  • Travel required throughout regional work locations
  • Occasional overnight travel 1-3 times a year throughout Colorado
  • Required to operate CDOT vehicles

Minimum Qualifications

Experience Only: Nine (9) years of full-time professional-level human resource management experience in an employment context where the primary responsibility of your duties was a focus on compliance with labor/employment laws and equal opportunity which included employee relations investigations. This experience must be specifically documented on your application.

Or Education and Experience: A combination of related education in Human Resources, Personnel Administration, Business Administration, Psychology, Sociology, Public Administration, Communications, or a closely related field and/or relevant experience in an occupation related to the work assigned equal to nine (9) years.

  • Experience with State of Colorado Personnel Rules and Procedures
  • Ability to interpret and apply policies, procedures, regulations, and federal laws
  • Experience with employee development programs
  • Excellent workplace investigative, interviewing and research skills
  • Experience responding to external agency requests (such as Equal Employment Opportunity Commission, State Personnel Board, Colorado Civil Rights Division) and assisting with defense of litigation
