About the role

The New York City Taxi & Limousine Commission (TLC) oversees a transportation ecosystem that moves nearly 1 million riders every day. TLC is the agency responsible for regulating New York City's taxicab and for-hire vehicle industry, including approximately 180,000 licensed drivers, 1,000 businesses, and 115,000 vehicles. The Prosecution Division investigates and prosecutes over 100,000 summonses issued by TLC annually.

The Prosecuting Attorney II will assist all Prosecution Units with summons processing, focusing on Port Authority summonses. This role involves appearing on summonses related to airport enforcement of regulations prohibiting impermissible solicitation, preparing case files, and supporting officer testimony and complaints. The position also includes supervising attorneys assigned to Port Authority cases, providing training to officers and prosecutors, and overseeing interns.

Responsibilities

  • Appear on summonses issued in connection with Port Authority’s airport enforcement of regulations under Sections 19-506 or 19-507 of the New York City Administrative Code.
  • Prepare case files for summonses issued by the Port Authority Police and complaints made by Airport Dispatchers.
  • Prepare officer testimony when necessary.
  • Supervise attorneys assigned to Port Authority cases.
  • Provide continuous training and guidance to officers on issuing summonses with sufficient narratives to establish rule violations.
  • Conduct prosecutor training and supervise interns.
  • Assist the managing attorney in other TLC prosecution matters.
  • Prosecute TLC summonses at OATH Hearings Division.
  • Review and edit charging documents prepared by prosecuting attorneys.
  • Oversee the preparation of evidence and witnesses for administrative hearings.
  • Oversee the division’s processing and issuance of stipulations based on individual and/or batch settlement requests.
  • Conduct micro trainings as required.

Qualifications

  • Admission to the New York State Bar.
  • One of the following:
    • One year of satisfactory United States legal experience subsequent to admission to any state bar; or
    • Six months of satisfactory service as an Agency Attorney Interne (30086).
  • Incumbents must remain Members of the New York State Bar in good standing for the duration of employment.

To be assigned to Assignment Level (AL) II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar in relevant areas of law.

To be assigned to AL III, candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar in relevant areas of law.

Pay

  • New Hire Rate: $83,000
  • After two (2) years of city employment: $95,450
