Prosecuting Attorney

The New York City Taxi & Limousine Commission (TLC) oversees a transportation ecosystem that moves nearly 1 million riders every day—the equivalent of the entire Boston transit system. TLC is the agency responsible for regulating New York City's taxicab and for-hire vehicle industry, including approximately 180,000 licensed drivers, 1,000 businesses, and 115,000 vehicles, with the iconic yellow taxi at the heart of the city’s identity. TLC is entering a new era of dignity, accountability, and collaboration across the for-hire vehicle sector and remains at the forefront of a rapidly changing mobility landscape. Its innovative efforts—such as requiring minimum pay for app drivers, ensuring wheelchair-accessible service, making the licensed fleet more environmentally sustainable, working to eliminate traffic fatalities, and preventing discriminatory service—often serve as a model for other cities.

The Prosecution Division investigates and prosecutes all summonses issued by TLC, including administrative, field, and consumer-initiated complaints. The division handles a wide range of violations, such as reckless driving, unlicensed operation, illegal street pickups, harassment, and leaving the scene of an accident. Prosecuting Attorneys represent TLC in cases heard before the Hearings Division of the Office of Administrative Trials and Hearings (OATH) and gain robust hands-on litigation experience through rotations in various prosecutorial assignments, including Consumer Intake, Settlements, Hearings, and Appeals.

Responsibilities

• Manage a daily caseload and independently represent the Taxi and Limousine Commission at administrative hearings, including preparing and presenting witnesses and evidence at trial.
• Evaluate case strengths and weaknesses to effectively negotiate plea and settlement agreements with respondents and/or their attorneys or representatives.
• Interview consumer complainants to obtain complaint details and determine appropriate charging violations and settlement offers.
• Review hearing dispositions for summonses dismissed at OATH; draft appeals and Chair petitions when appropriate.

Requirements

• Admission to the New York State Bar.
• One of the following:
  • One year of satisfactory United States legal experience subsequent to admission to any state bar; or
  • Six months of satisfactory service as an Agency Attorney Interne (30086).
• Incumbents must remain Members of the New York State Bar in good standing for the duration of employment.

Qualifications

To be assigned to Assignment Level (AL) II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar in relevant areas of law.

To be assigned to AL III, candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar in relevant areas of law.

Pay

• New Hire Rate: $73,476
• After two years of city employment: $84,498
