Essential Functions And Responsibilities
- Analyze proposed project owner and subcontractor agreements to identify commercial, operational, and legal risks and opportunities.
- Confirm consistency between owner contract terms and subcontract terms, ensuring that subcontract agreements include all project requirements and flow-down obligations from the owner contract to the subcontractor.
- Collaborate with team members in Estimating, Preconstruction, and Project Management about contract risks and negotiations.
- Communicate with owner and subcontractor representatives to negotiate contract terms in a professional, collaborative, and solutions-oriented manner.
- Draft negotiated terms (balancing risk management objectives with project and business goals) with support from supervisor, team members, and Legal when needed.
- Consult with brokers and advisors about insurance terms and bonding to align coverage with contract obligations.
- Work with other team members to ensure that CK maintains complete and accurate contract records.
- Aid in developing contract templates, standard terms, and limits and reasons for negotiated compromises.
Skills And Abilities
- Experienced understanding of terms commonly used in construction agreements.
- Effective management of contract terms to ensure consistency across numerous documents.
- Basic knowledge of how construction contracts allocate project risks.
- Basic working knowledge of commercial general liability, builder’s risk, and professional liability insurance policies work in respect to construction projects.
- Ability to explain contract provisions in clear layperson terms.
- Experienced professional negotiation skills with strong interpersonal skills.
- Strong proficiency using redlining, addendums, and other methods of tracking and documenting contract negotiations.
- Strong reading comprehension.
- Strong grammar, usage, and writing skills.
- Strong organizational skills.
Certificates, Licenses, And Registrations
- Must have a valid driver’s license and be able to comply with the company’s Authorized Driver policy.
Education And Experience
- Required: Four-year construction management, business, or law degree (or equivalent combination of training, construction management, business, law, or related field experience).
- Required: 3-5 years of construction contracting experience.
- Experience reviewing both owner contracts and subcontracts.
- Familiarity with AIA, ConsensusDocs, and OFCC contract forms.
