About the role

The Deputy Director, Office of Enforcement, under the general direction of the Director and Chief Deputy Director of the DMHC, plans, organizes, manages, and directs statewide litigation activities for the DMHC’s Enforcement Program. This includes oversight of the Division of Prosecution, the Division of Investigation, and the Division of Legal Administration. The incumbent serves as principal advisor and litigator to the Director and Chief Deputy Director, providing strategic recommendations on enforcement program operations. The role involves policy development, strategic planning, implementation, and evaluation of enforcement operations, as well as supervising attorneys, managers, and support staff. The Deputy Director may personally handle the most difficult, complex, and sensitive legal work related to the enforcement of the Knox-Keene Health Care Services Plan Act of 1975. The incumbent also serves as a member of the DMHC’s executive management team and attends meetings to provide enforcement-related information on DMHC and statewide policy issues.

Responsibilities

  • Oversee statewide litigation activities of the DMHC’s Enforcement Program, including the Division of Prosecution, the Division of Investigation, and the Division of Legal Administration.
  • Provide enforcement-related information and policy guidance at meetings regarding DMHC and statewide policy issues.
  • Develop, implement, and evaluate policies and strategic plans for the Office of Enforcement’s operations.
  • Serve as principal advisor to the Director and Chief Deputy Director on enforcement program operations, offering alternatives and recommendations.
  • Supervise attorneys, managers, and support staff within the Office of Enforcement.
  • Personally perform the most difficult, complex, and sensitive legal work related to the enforcement of the Knox-Keene Health Care Services Plan Act of 1975.
  • Contribute as a member of the DMHC’s executive management team.

Special Requirements

  • A background investigation must be cleared prior to hire.
  • An active California State Bar License is required; a copy must be provided prior to hire.
  • Applicants not currently employed by the DMHC will undergo a pre-employment background investigation, including fingerprinting and an inquiry to the California Department of Justice for criminal records.
  • If using education to meet minimum qualifications, unofficial transcripts may be accepted during the application process; official transcripts may be required prior to appointment.

Desirable Qualifications

  • Demonstrated experience planning, organizing, managing, and directing staff activities in statewide litigation, including investigations, legal proceedings, appellate cases, settlements, post-trial negotiations, legal research, and hearings.
  • Demonstrated experience implementing and applying health care laws and other applicable state and federal laws, as well as statewide legal policy and precedence, including analyzing complex legal issues involving statutes and regulations.
  • Demonstrated experience evaluating enforcement, prosecution, or litigation program operations to identify areas for improvement, assess cost efficiencies, and implement effective solutions.
  • Demonstrated ability to perform high-level litigation activities and policy-influencing functions, including working effectively under pressure and making high-level decisions in a fast-paced and changing environment.
  • Demonstrated ability to identify and implement solutions to meet operational challenges through subordinate managers and supervisors, including strategic planning and implementation.
