Data Center Contracts
About the role
The Construction Team at Fluidstack is responsible for delivering one of the largest data center buildouts of its kind, with many sites running at once. They focus on speed and scale, breaking down traditional construction management methods and reinventing how gigawatts get built.
Responsibilities
- Own end-to-end contracts management across EPC construction, engineering and design services, professional services, and equipment procurement, on programs from $500M to $2.5B+ in construction value.
- Lead negotiation of EPC, GMP, lump sum, and design-build contracts ($200M+), including multi-package delivery structures.
- Develop the contracts playbook and clause library: bonding, LD frameworks, subcontractor provisions, IP ownership, cost-sharing, and guarantees.
- Structure GC procurement for a supply-constrained Tier 1 market (PCSAs, retainer exclusivity, MSAs with volume commitments), and serve as primary commercial contact with GCs on change orders, pay applications, and claims.
- Cook with legal on enforcement (notices, cure periods, terminations, surety bond claims), and monitor insurance, bonding, and compliance across the contractor portfolio.
- Build the contracts function from the ground up: tooling, workflows, approval routing, and document management (Procore, ACC, or equivalent), and build commercial literacy across the construction team.
Requirements
- You've managed construction contracts on heavy civil, industrial, or mission-critical infrastructure (data center, semiconductor fab, power generation, or similar).
- You've negotiated EPC, GMP, and design-build contracts exceeding $200M in construction value.
- You know AIA, ConsensusDocs, or FIDIC forms and owner-favorable modifications deeply.
- You've run performance bond and surety programs, including bond claims and alternative security structures.
- You manage contractor disputes, claims, and enforcement, and you understand how contracts interface with schedule, cost reporting, and earned value.
Qualifications
- Bachelor's degree in Engineering, Construction Management, Business Administration, or related field.
- Minimum 10 years of relevant experience in construction contract management.
- Experience with AIA, ConsensusDocs, or FIDIC forms and owner-favorable modifications.
- Strong understanding of performance bonds and surety programs.
- Experience managing contractor disputes, claims, and enforcement.
- Experience with Procore, ACC, Ariba, Coupa, or NetSuite.
- Experience with project finance and construction loan mechanics.
- Experience with modular or prefabricated delivery.

Pay
The base salary range for this position is $180,000 - $200,000 per year, depending on experience, skills, qualifications, and location. This range represents our good faith estimate of the compensation for this role at the time of posting. Total compensation may also include equity in the form of stock options.
