About the role
Tisher Liner FC’s Construction Law practice area assists clients with construction legal requirements, including:
- Review and preparation of commercial building contracts
- Review and preparation of contractor agreements
- Dealing with claims and issues concerning the Building and Construction Industry Security of Payment Act
Our expert lawyers also assist with commercial and residential building disputes and provide advice on commercial and residential building contracts. We handle building disputes through the Victorian Civil and Administrative Tribunal (VCAT) and Courts, including settlements at mediation to avoid lengthy and expensive trials. Additionally, we advise on multi-unit buildings, acting on behalf of Owners Corporations and Strata managers in Victoria.
Security of Payment Act
The Security of Payment legislation protects businesses operating in all jurisdictions of Australia. We advise businesses about their rights regarding payments to ensure compliance with the legislation. Our regular services include:
- Contracting: Advising and preparing construction contracts for any type of job before work begins.
- Progress Claims: Assisting in recovering debts owed by clients who refuse to pay the full amount, including submitting claims compliant with the legislation to maximize recovery prospects.
- Payment Schedules: Advising on the necessity and process of providing detailed payment schedules to avoid disputes and meet legislative requirements.
- Adjudications: Assisting with and running adjudication disputes to enforce rights under the Security of Payment Act in a cost-effective manner.
