Key Responsibilities
- Manages an inventory of high-value, complex A&E professional liability and casualty claims, often involving litigation.
- Conducts the investigation, evaluation, negotiation, and resolution of complex claims involving design errors, omissions, and professional negligence, with support from external experts where appropriate.
- Represents the company and clients by participating in or leading litigation teams, particularly in cases involving construction projects and design professional liability exposures.
- Independently resolves claims with significant exposure on favorable terms, balancing financial outcomes and client relationships.
- Effectively manages and controls the work, strategy, and costs of outside counsel, technical experts (e.g., engineers, architects), and other service providers.
- Performs detailed coverage analysis on professional liability and casualty policies (including manuscript forms), identifying coverage issues and preparing coverage position letters as needed.
- Operates within designated authority for reserving, claim disposition, and payments, ensuring accuracy in high-exposure cases.
- Prepares timely and accurate reports for management on complex losses; proactively communicates developments, risks, and strategies.
- Led or participates in mediations, arbitrations, and negotiations, particularly in technically complex A&E disputes.
- Builds strong relationships with insureds (design firms), brokers, internal stakeholders, and international colleagues, delivering exceptional service.
- Makes decisions that significantly impact financial results and client outcomes, especially in long-tail, high-severity claims.
- Identifies and pursues subrogation and recovery opportunities, particularly where multiple parties contribute to design or construction failures.
- Shares lessons learned and emerging trends (e.g., design risk exposures, construction practices) with underwriting and other departments.
Qualifications and Experience
- Bachelor’s Degree required; professional degrees or coursework in engineering, architecture, construction management, or related fields preferred.
- Minimum of 5+ years of relevant claims experience, with a focus on A&E professional liability, construction defect, or design-related casualty claims.
- Willingness to obtain and maintain state adjuster licenses and complete continuing education requirements.
- Strong experience in litigation and claims management involving design professionals, including familiarity with standard of care issues, contracts, and project delivery methods.
- Expertise in claims handling, coverage interpretation, technical analysis, and negotiation.
- Ability to analyze technical reports, expert opinions, construction documents, contracts, and project records.
- Excellent verbal and written communication skills, with the ability to explain complex technical concepts clearly.
- Strong attention to detail, analytical thinking, and problem-solving skills.
- Exceptional organizational and time management abilities; capable of managing multiple complex files simultaneously.
- Adaptable and comfortable working in a dynamic, evolving claims environment.
- Commitment to delivering outstanding service to clients, brokers, and internal partners.
- Proficiency in Microsoft Office and claims management systems.
