Job Responsibilities
The primary responsibilities of a field prosecutor include:
- Prosecuting Driving Under the Influence (DUI) cases
- Assisting law enforcement officers with the prosecution of magistrate level offenses in South Carolina courts
- Investing time to try cases and appeal them as necessary
- Assigning to a Highway Patrol troop for field work, embedding with officers and becoming a resource for prosecution and legal advice
- Helping officers focus on enforcement duties by taking some of the courtroom burdens
- Providing legal advice on Title 56-related topics such as substantive criminal law, criminal procedure, and statutory interpretation
- Handling discovery requests and appeals of Title 56 cases to circuit court
- Conducting training and mentoring for department personnel on prosecution of Title 56 offenses
- Handling pre-trial matters in selected Title 56 cases in summary court
- Serving as an Employee Advisor regarding investigation/disciplinary matters
Minimum And Additional Requirements
State Minimum Requirements:
- A juris doctor degree or its equivalent from an accredited law school
- Experience as a practicing attorney
Agency Minimum Requirements:
- A juris doctor degree or its equivalent from an accredited law school
- Five (5) years of experience as a practicing attorney
- Member in good standing of the South Carolina Bar
- Completion of trial experience requirement pursuant to Rule 403, SCACR
Knowledge required includes:
- General case, statutory and common law
- Effective communication skills, both oral and written
- Ability to maintain confidentiality and work independently
