Description Of Duties/Essential Functions
Under the administrative direction of the Deputy General Counsel of the Sales, Excise and Property Tax Litigation Office, performs highly specialized legal and technical duties in the Sales, Excise and Property Tax Litigation Office.
- Represents the Department before the Department’s Administrative Law Judge Office in quasi-judicial litigation matters with Illinois and out-of-state taxpayers as they relate to sales, excise, income, and property tax cases.
- Confers and corresponds with taxpayers, their attorneys, witnesses, and administrative law judges.
- Prepares written memoranda to assist administrative law judges.
- Attends hearings and conducts litigation conferences as directed by supervisor.
- Assists supervisor in preparing legal documents.
- Develops and has access to information regarding pending decisions involving negotiations and settlement agreements.
- Participates as an expert and whose advice key decision-makers rely on in formulating administrative policies on drafting and interpreting statutes, rules, internal policies and other resource material.
- Researches and analyzes statutes, rules, and other resource material pertinent to litigating cases.
- Provides recommendations which must be considered in the development or modification of programs and services where there is considerable room for principled disagreement on the interpretation of requests.
- Drafts legislation, rules, and departmental policy statements as directed by supervisor.
- Performs general tax law duties for related divisions or agencies of Lottery, Racing, Gaming, and Liquor cases as necessitated by workload.
Minimum Requirements
- Graduation from a recognized law school.
- Possession of a license to practice law in Illinois.
- 3 years professional experience in the practice of law.
- Thorough knowledge of common law and of the State and Federal laws, particularly relating to administrative and regulatory functions.
- Extensive knowledge of judicial and quasi-judicial procedure and of the rules of evidence, hearings, and trials procedures.
- Extensive knowledge in the field of law with which primarily concerned.
- Working knowledge of principles of administration and management, including organization, controls and techniques used dealing with management and procedural problems.
- Able to travel.
