About the role

Under general direction, an incumbent within this classification serves people who are legally interested in a case and who are dissatisfied with an Agency Decision have a constitutionally-protected right to file an appeal from that decision. When an appeal is filed, unemployment hearing officer conducts a hearing wherein hearing participants are placed under oath, parties are allowed to examine his/her own witnesses, and cross-examine opposing parties and his/her witnesses, admits tangible things into evidence, and builds the record that often serves as the sole basis for judicial review. After conducting a hearing, the unemployment hearing officer issues a written decision wherein express findings of fact are made, and legal conclusions of law are drawn from those facts.

This classification is different than the Unemployment Hearing Officer 1 classification in that the person in this classification will also preside over more complex appeals. This classification differs from the Unemployment Hearing Officer 3 in that the person in this position will also have to review an unemployment hearing officer's work and verify that the work was performed pursuant to federal and state requirements.
