About the role
The Sr. Counsel, Global Labor & Employment is a critical strategic role responsible for providing comprehensive legal advice and guidance on a wide range of global labor and employment matters, while also supporting broader litigation, investigations, and other legal matters as business needs require. Reporting directly to the Chief Legal Officer, this individual will serve as the primary subject matter expert, ensuring compliance with labor and employment laws across all jurisdictions of operation, mitigating risk, and supporting the company's growth and talent strategies. This highly influential individual contributor role requires exceptional legal acumen, business judgment, and the ability to operate effectively in a fast-paced, global environment.
Responsibilities
- Employment Law:
- Provide day-to-day counseling on state and federal employment law, including discipline, terminations, anti-discrimination, anti-harassment, disability law leaves, and reductions-in-force.
- Develop and present executive-level briefings, recommendations, and risk assessments to the Chief Legal Officer and others regarding employment litigation, workforce strategy, regulatory developments, and significant employment-related matters.
- Provide ex-US legal support for the EU, UK, and APAC regions in all material aspects as provided domestically.
- Assist with Global Business Conduct cases regarding employee investigations and discipline arising from violations of company policy.
- Support the onboarding of international employees.
- Create and deliver employment law-based training programs for management and general employee audiences.
- Manage litigation arising from employment law claims and support other litigation, investigations, and dispute resolution matters, as assigned, in partnership with internal and external counsel.
- Conduct statistical analyses for pay equity, compensation review, variable compensation, and reductions-in-force.
- Advise on the use of temporary and contract employees and prepare/negotiate service agreements with temporary labor providers.
- Address all employment law issues in divestitures and acquisitions.
- Advise on employment contracts, non-competition agreements, confidentiality clauses (in collaboration with Intellectual Property attorneys), and their enforcement.
- Advise on workers' compensation cases.
- Advise on Human Resource workplace policies (drug/alcohol, security/workplace violence).
- Advise on workplace closings, staffing reductions, redeployments, severance issues, and required WARN notifications.
- Advise on HIPAA and state-based privacy issues.
- Provide legal support for Department of Labor reviews of plans, information requests, and correction procedures.
- Demonstrate a commitment to diversity, equity, and inclusion through continuous development, modeling inclusive behaviors, and proactively managing bias.
- Labor Law:
- Provide day-to-day counseling in U.S. labor law.
- Provide strategic updates and risk assessments to the Chief Legal Officer and others regarding labor relations matters, workforce trends, union-related developments, and associated business risks.
- Defend charges under the National Labor Relations Act: unfair labor practices, grievances, and arbitrations.
- Provide training for management on union-free workplaces and defense of charges under the National Labor Relations Act.
- Draft workplace policies consistent with labor law and “protected activities.”
- Employee Benefits Law:
- Provide day-to-day counsel regarding the administration and interpretation of Eversana’s ERISA welfare and tax-qualified plans.
- Support the Compensation/Benefits organization and Treasury organization regarding plan amendments, new plan features, annuity lift-outs, discontinuation of benefits, and plan terminations.
- Collaborate on and review all communications to plan participants, including year-end election materials.
- Manage benefits-based litigation and the plan appeal process.
- Draft, review, and assist in the negotiation of administrative services agreements.
- Advise the Company employee service center regarding employee and participant requests.
- Advise on benefit interpretations and benefits offered in collective bargaining agreements.
- All other duties as assigned.
Requirements
- Juris Doctor from an accredited law school.
- Bar admission.
- 10-12+ years of relevant law firm and/or corporate law department experience.
- Global labor and employment experience with APAC, EU, and UK.
- Collaborative style, accustomed to working on teams, with excellent communication, presentation, and writing skills.
- Pragmatic approach and problem-solving skills with demonstrated ability to influence organizational outcomes through strategic legal counsel.
Preferred Qualifications
- Health privacy law expertise (HIPAA marketing, GDPR sensitive personal data/health data transfers, etc.).
- Prior in-house experience.
- Prior employment litigation experience; broader litigation, investigations, or dispute resolution experience preferred.
Schedule
- Full-time (40 hours, Monday through Friday).
- Minimal travel, with a maximum of two multi-day summits per calendar year.
Pay
The anticipated base salary range for this position is $84,000 to $117,000 and is applicable to U.S. locations only. Compensation will be determined based on relevant experience, other job-related qualifications/skills, and geographic location (to account for comparative cost of living).
