Senior Counsel, Government Investigation & Litigation

About the Role

This remote position may be based in California, Oregon, Washington, Colorado, Georgia, Maryland, Virginia, Washington, D.C., or Hawaii. The role involves managing outside counsel relationships to craft litigation strategy aligned with company-wide business objectives, particularly for portfolios of high reputational and economic significance. Key responsibilities include:

• Leading collaborations with business teams to implement key changes and ensure alignment with overall strategy.
• Overseeing cross-functional communications with business groups, government, clinical, and other internal teams to achieve common goals.
• Providing practical and effective legal advice to prevent, mitigate, and resolve legal, regulatory, and enterprise risk.
• Proactively identifying government enforcement risk areas and addressing them within compliance and operations.
• Managing a team of lawyers to deliver efficient and proactive legal services, including handling high-risk cases and escalating as necessary.
• Counseling on remediation of identified risk areas during investigations and implementing guidelines and standards.
• Establishing legal arguments, representing the organization in legal proceedings, mediation, and settlement negotiations.
• Providing strategic legal advice on complex risk initiatives, remediation, and compliance projects.
• Advising the enterprise on highly complex legal and risk matters and collaborating on solutions to unique operational concerns.

Responsibilities

• Legal Documents: Participate in the creation, review, and negotiation of legal documents, including drafting highly complex and nuanced written advice, contracts, and other documents. Oversee the work product of others and provide expert guidance to clients and legal professionals.
• Legal Research: Perform or manage highly complex research and analysis of case law, statutory/regulatory authority, and industry trends. Synthesize findings and communicate legal analysis to senior business stakeholders to inform strategy and decisions.
• Legal Risk Assessment: Apply expert knowledge of legal principles, business risks, and regulatory landscapes to provide legal advice and recommendations. Lead legal strategies for senior stakeholders, implement innovative solutions to mitigate risks, and manage outside counsel on complex matters. Oversee junior attorneys and guide them in their areas of expertise.
• Legal Planning and Strategy: Formulate and manage legal strategy for significant and innovative solutions to unique issues. Drive resolution of complex legal issues through collaboration. Advise senior stakeholders on health plan, care delivery, and clinical strategies. Engage with regulatory services and government relations on advocacy strategies to address legislative, regulatory, and litigation risk. Lead or guide responses to regulatory actions such as audits and enforcement actions.

Requirements

• Minimum ten (10) years of experience as a practicing lawyer.
• Minimum five (5) years of experience in litigation (discovery, law & motion, experts, pre-trial, trial/arbitration).
• Juris Doctorate (JD) or equivalent (e.g., LLB, LLM, PCLL).
• Active State Bar License from any state where Kaiser Permanente does business.

Preferred Qualifications

• Significant experience as a practicing attorney, including at least 10 years of legal practice and 5 years of litigation experience focused on government investigations, enforcement actions, internal investigations, and regulatory response, particularly in healthcare.
• Experience managing complex litigation portfolios with high reputational, regulatory, and economic risk.
• Ability to oversee and manage outside counsel relationships, including litigation strategy, cost control, and risk mitigation.
• Experience advising on high-risk legal, regulatory, compliance, and enterprise risk matters.
• Experience collaborating with senior business, clinical, government relations, compliance, operations, and legal stakeholders in a highly matrixed environment.
• Two (2) years of experience advising in areas of fraud, waste, and abuse.
• Experience with Anti-Kickback Statute and Stark Law.
• Prior experience advising on compliance programs.
• Prior experience performing pre-acquisition due diligence related to litigation risk.

Schedule

• Full-time (40 hours per week).
• Shift: Day (Monday–Friday, 08:00 AM – 05:00 PM).

Pay

The posted pay range is $243,000 – $303,750 per year. Actual base pay will be determined based on labor market data, internal alignment, and a candidate’s relevant work experience, education, certifications, skills, and geographic location.
