About the role
The Senior Counsel - Global Commercial Operations will provide strategic legal guidance supporting commercial activities within the biopharmaceutical industry. This role will partner closely with business teams to navigate complex healthcare regulations, promotional requirements, and commercial initiatives.
Responsibilities
- Provide legal and regulatory counsel to commercial operations teams regarding promotion, sales, patient support programs, education, and scientific exchange activities.
- Review, analyze, and approve promotional materials, educational content, and commercial support programs to ensure compliance with applicable requirements.
- Advise on scientific exchange initiatives, clinical support approaches, and communications involving healthcare professionals.
- Provide guidance on sales and marketing strategies while balancing business objectives with legal and regulatory obligations.
- Counsel teams on government enforcement actions, healthcare compliance matters, and evolving industry requirements.
- Advise on complex commercial transactions involving hospitals, clinics, payers, specialty pharmacies, pharmacy benefit managers, and healthcare organizations.
- Support compliance with healthcare fraud and abuse laws, including Anti-Kickback Statutes, False Claims Statutes, and relevant antitrust requirements.
- Review and advise on precision medicine programs involving patient and provider initiatives, biomarkers, and companion diagnostics.
- Develop and deliver legal and regulatory training programs for commercial teams.
- Collaborate with cross-functional stakeholders to identify risks, develop solutions, and support compliant business execution.
- Manage multiple legal projects while maintaining strong client service and business partnership.
Requirements
- An experienced healthcare or life sciences attorney with strong regulatory knowledge and the ability to provide practical legal guidance to business teams.
- Excellent communication skills, strategic thinking, and experience managing complex legal matters.
- J.D. or LL.M. degree from an accredited law school. Admission to practice law in at least one U.S. jurisdiction. Minimum of 4 years of legal practice experience. 6+ years of experience preferred in corporate legal departments or law firms supporting healthcare, pharmaceutical, biotechnology, or life sciences clients.
- Experience advising on healthcare fraud and abuse matters, FDA promotional regulations, OIG compliance guidance, DOJ settlements, Medicare/Medicaid reimbursement, and healthcare contracting.
- A strong understanding of legal and regulatory considerations affecting commercial activities in the biopharmaceutical industry.
- Experience reviewing and negotiating complex healthcare-related agreements and business arrangements.
- Familiarity with precision medicine programs, novel biomarkers, and companion diagnostic considerations preferred.
- Excellent legal analysis, drafting, negotiation, and communication skills.
- The ability to influence stakeholders and provide practical business-oriented solutions.
- Strong project management skills with the ability to manage multiple priorities in a fast-moving environment.
- Demonstrated ability to collaborate effectively with cross-functional teams and senior leaders.
Pay
Competitive annual salary range of $226,114.45 to $305,919.55 depending on experience, qualifications, skills, and location.
Schedule
Remote work flexibility across the United States, with limited travel requirements.
