We are currently seeking a Residential Real Estate Title Review Attorney, licensed in South Carolina.
Responsibilities
- Title Examination and Curative Work
- Conduct thorough title review and examination of assigned title searches.
- Analyze deeds, mortgages, judgments, estates, trusts, liens, and other legal instruments affecting title.
- Evaluate, identify, and resolve title defects, curative matters, and underwriting concerns.
- Prepare preliminary and final title opinions and communicate findings to internal teams and title insurance underwriters.
- Review commitments and supporting documentation for accuracy and compliance before submission to title insurance companies.
- Legal Document Preparation and Review
- Draft and review legal documents necessary to cure title and facilitate closing, including but not limited to:
- Deeds
- Powers of Attorney
- Open Estate Indemnity Agreements
- Agent Certifications
- Satisfactions and Releases
- Affidavits of Correction
- Estate-related documents
- Other transaction-specific legal instruments
- Client and Transaction Support
- Serve as a legal resource for clients, paralegals, and closing attorneys regarding title matters.
- Communicate directly with buyers, sellers, real estate agents, lenders, and other parties when legal guidance is required.
- Participate in client-facing interactions, including:
- Discussing legal documents pertaining to title with clients.
- Addressing title and closing-related concerns.
- Explaining ownership, vesting, marital interest, estate, and other legal issues that may impact the transaction.
- Aiding with closing-day questions and issues as needed.
- Due Diligence and Compliance Review
- Review restrictive covenants, declarations, CCRs, HOA documents, and other recorded instruments to identify provisions impacting insurability, ownership rights, occupancy, leasing restrictions, or lender requirements.
- Conduct detailed review of legal records and supporting documentation necessary to satisfy underwriting and closing requirements.
- Ensure all legal work complies with applicable state laws, underwriting guidelines, and firm policies.
- Operational Responsibilities
- Handle a high volume of transactions while maintaining accuracy, responsiveness, and exceptional client service.
- Sign Final Title Opinions (FTOs) and other attorney certifications as required.
- Collaborate with internal teams to ensure files progress efficiently from title review through post-closing.
- Assist with office coverage and provide support for in-office attorneys when business needs require based on location.
- Fill in occasionally for in-office Attorneys depending on home location.
- JD from an accredited law school.
- Active license to practice law in South Carolina (required); North Carolina or Georgia license is a plus.
- 2+ years of real estate law experience.
- Notary Public (or willingness to obtain before start date).
- Excellent written and verbal communication skills.
- A strong sense of professionalism, attention to detail, and customer service mindset.
- Must be currently or previously approved by multiple title insurance companies.
- Proven ability to analyze, prioritize, and execute multiple projects and complex tasks under a deadline.
- Experience meeting and exceeding set title review goals.
- Must be currently licensed to practice law in South Carolina.
- Must have a strong understanding of real estate law and title insurance processes.
- Must be able to work independently and meet monthly goals.
- Must have excellent interpersonal and communication skills.
- Must be able to handle a high volume of transactions with accuracy and efficiency.
- Strong analytical and problem-solving skills.
