Foster Garvey PC seeks a partner-level attorney to join its Consumer Brands industry group, focusing on FDA regulatory matters and working with clients in the food and beverage, dietary supplement, cosmetics, wellness, and broader consumer products industries. This role offers the opportunity to help lead and grow the Firm’s FDA and consumer products regulatory capabilities while collaborating with a multidisciplinary team representing consumer brands, investors, lenders, and strategic partners.

About the role

The successful candidate will play a significant role in the continued growth of the Firm’s FDA and consumer products regulatory practice, serving as a key advisor to clients on compliance matters. The position involves counseling clients throughout the business lifecycle, including formation, commercial arrangements, strategic partnerships, financings, acquisitions, and liquidity events. The attorney will also lead regulatory aspects of sophisticated financing, investment, and M&A transactions, working closely with investors, lenders, and operating companies to identify, evaluate, and manage regulatory risk.

Responsibilities

  • Counsel clients on FDA regulatory compliance matters affecting food, beverage, dietary supplement, cosmetics, and other consumer product companies, including labeling, packaging, advertising, ingredient compliance, inspections, enforcement, recalls, and emerging regulatory developments.
  • Advise on regulatory issues related to the Consumer Product Safety Commission (CPSC), Federal Trade Commission (FTC), and other federal or state regulatory regimes affecting consumer products.
  • Lead regulatory aspects of financing, investment, and M&A transactions, collaborating with investors, lenders, and operating companies to assess and manage regulatory risk.
  • Negotiate and advise on commercial agreements in the consumer brands and consumer products industries, including manufacturing, co-packing, supply, distribution, logistics, and fulfillment arrangements.
  • Provide guidance on intellectual property protection, licensing, and other brand-related matters.
  • Work collaboratively across practices and offices while managing multiple matters efficiently.
  • Contribute to business development and practice growth, including cultivating a portable book of business.

Requirements

  • At least seven years of significant experience advising clients on FDA regulatory compliance matters, with substantial experience involving food, beverage, dietary supplements, cosmetics, and/or other consumer products.
  • Experience advising clients on USDA regulatory compliance matters.
  • A portable book of business and demonstrated interest in developing and growing client relationships.
  • Admission to practice law in at least one U.S. jurisdiction, with the ability to become admitted as required in the attorney’s office jurisdiction; California Bar admission is a plus.
  • Strong analytical, writing, and communication skills, with sound business judgment and a practical, client-focused approach to regulatory counseling.
  • Demonstrated interest in business development and practice growth.
  • The ability to work collaboratively across practices and offices as well as independently.
  • A commitment to responsive and professional client service.

Skills

The following experience is a plus:

  • Advising on CPSC, FTC, and related federal or state regulatory matters.
  • Negotiating or advising on commercial agreements in the consumer brands or consumer products industries.
  • Advising on regulatory issues arising in M&A, financing, and investment transactions.

Pay

The annualized salary range for this position is $250,000 to $450,000. Actual pay will be adjusted based on the candidate’s relevant experience, location, and other job-related factors permitted by law.
