Patent Agent - Photobiomodulation

Role Snapshot

Location/Schedule: Remote, Full-Time
Purpose: Own end-to-end prosecution for photobiomodulation, therapeutic optics, and wavelength-based innovation within a high-speed in-house patent operation.

Key Responsibilities

• Review and redline AI-drafted patent applications in the PBM domain with production-speed turnaround expectations.
• File provisionals, non-provisionals, PCT applications, and continuations through USPTO Patent Center.
• Independently sign and prosecute filings under your own USPTO Patent Agent authority.
• Respond to office actions involving 101, 112, 102, and 103 issues within PBM and therapeutic-optics subject matter.
• Conduct examiner interviews when strategically beneficial.
• Collaborate with researchers, engineers, and inventor teams to convert technical and clinical concepts into prosecutable claim strategies.
• Identify gaps, prior-art exposure, and technical weaknesses in AI-generated drafts.
• Feed prosecution insights and rejection trends back into the Patent Engine workflow to improve drafting quality over time.

Must-have Qualifications

• Active USPTO Patent Bar registration in good standing.
• Minimum 4 years of patent prosecution experience post-registration.
• Minimum 30 patent applications drafted, prosecuted, or substantively responded to in PBM, biomedical optics, photonic devices, or laser-medical domains.
• Strong technical degree in Electrical Engineering, Biomedical Engineering, Biomedical Optics, Biophysics, Physics, or related discipline.
• Demonstrated experience navigating 101 method-of-treatment eligibility strategy.
• Ability to operate independently without attorney supervision.
• Comfortable working in AI-assisted drafting environments with high production velocity.

Preferred Qualifications

• Direct prosecution experience in PBM, therapeutic optics, or laser-medical device patenting.
• Advanced degree (MS or PhD) in a relevant technical discipline.
• Prior in-house experience within optical-device or laser-medical companies.
• Experience within elite patent prosecution environments focused on medical devices or optics.
• Familiarity with FDA Class II/III device pathways and clinical-method adjacency.
• Hands-on experience with AI-assisted drafting workflows in production settings.

Honest Challenge

This role operates at a significantly faster pace than traditional law-firm prosecution environments. Candidates must be comfortable reviewing AI-generated drafts rapidly, making independent prosecution decisions, and operating without attorney supervision. Completing the short embedded application step is required to be considered.

Pay

The pay range for this position is $140,000.00 to $200,000.00. Additional factors considered in extending an offer include (but are not limited to) experience, including industry or specific experience, education, knowledge, skills, and abilities, as well as internal equity, alignment with market data, and/or other applicable laws.
