An O-1B visa is for individuals with extraordinary ability in the arts or extraordinary achievement in the motion picture or television industry. It is recommended for leaders in the arts who demonstrate a degree of skill and recognition substantially above the norm, or for those in film/TV who can show a record of extraordinary achievement.

General Requirements

To qualify, you must be sponsored by a U.S. employer or agent on a part-time or full-time basis. Petitions should include evidence of at least three of the following:

  • Lead role in a production with a distinguished reputation
  • Critical reviews in major newspapers or trade journals
  • Lead role for an organization with a distinguished reputation
  • Record of major commercial or critically acclaimed success
  • Significant recognition from organizations, critics, government agencies, or other recognized experts in the field
  • Commanded or will command a high salary

Filing Process

USCIS has recently applied strict scrutiny to O-1 petitions, often requiring more evidence than the minimum. As a result, petitions tend to be document-heavy, demanding extensive proof of your standing as a top professional in your field. It is critical to evaluate all available evidence and present your strengths effectively.

Validity

O-1 petitions can be approved for up to three years at a time, depending on the length of the job offer or itinerary submitted. There is currently no limit on the number of extensions an individual may receive.
