About the Role
Mintz’s Health Law Practice is uniquely positioned to guide clients through structural and operational challenges. The Managed Care, PBMs & Pharmacies practice sits within our nationally recognized Health Law Practice, offering a broad-based service including compliance and regulatory counseling, health care due diligence, dedicated health care M&A, HIPAA privacy and security, FDA regulatory, billing and reimbursement, and health care enforcement defense.
Our comprehensive knowledge of health plans, payers, PBMs, and the overall pharmacy supply chain enables us to provide insightful and strategic counsel on all aspects of the legal landscape and policy initiatives related to managed care, drug benefit, and pharmacy operations. We leverage a cross-disciplinary approach, drawing upon related practices within the firm to address client challenges and expand business opportunities.
Responsibilities
- Support a team advising national and regional health plans on contracting relationships with pharmacy benefit managers (PBMs) and other pharmaceutical supply chain vendors.
- Supervise associates on a wide range of commercial agreements and transactions central to pharmacy benefit operations for health plans, payors, and other service providers.
- Lead and manage all aspects of commercial contracting in the managed care and pharmacy benefit industries, including drafting, negotiating, and advising on contract administration for PBM contracts and related services agreements (e.g., rebate contracts, pharmacy network contracts, and vendor arrangements).
- Oversee the contracting lifecycle for PBM procurements for health plans, serving as a primary client contact, which may require occasional travel to client sites for in-person meetings and negotiations.
- Counsel clients on health plan operations, including complex regulatory frameworks, transactional considerations, and contract administration issues, including disputes with PBMs, health plans, and third parties.
- Independently lead day-to-day client engagements, contract negotiations, and work streams while collaborating closely with partners and Mintz team members.
- Demonstrate strong organizational, communication, and attention to detail, with the ability to anticipate and respond to client needs effectively.
- Work from the office approximately 60% of the time in accordance with firm guidelines.
Qualifications
- JD or LLM from an ABA-accredited law school.
- Admitted to or eligible for admission in New York or Washington, DC.
- Substantial transactional experience in the managed care or pharmaceutical supply chain industries, with a preference for candidates familiar with federal and state regulations of health plans, PBMs, and related entities.
- Proven experience drafting and negotiating complex commercial contracts, managing multiple contract workflows, and coordinating with clients, co-counsel, and opposing counsel.
- Excellent written and verbal communication skills, professionalism in client interactions, and the ability to balance competing priorities.
- Strong organizational skills, attention to detail, and ability to collaborate effectively in team settings.
Attorneys with in-house experience in the managed care industry or senior associates and counsel with managed care or pharmaceutical supply chain transactional experience are encouraged to apply.

Pay
The salary range for this position is $200,000 to $345,000, and the role is bonus eligible.
