About the role

The DCT Ethics Officer/Contracts and Healthcare Compliance Attorney will serve as DCT's lead contract negotiator and lead agency legal subject matter expert in multiple areas of practice, including contracting, real property, Medicaid and Medicare law and regulation, insurance and risk management, intellectual property (copyright, trade secrets, and trademark), compliance and ethics matters.

Responsibilities

  • Act independently in reviewing and approving the Agency’s array of requests for proposals, requests for bids, professional/technical contracts, data sharing agreements, grant contracts, business associate agreements, payer/provider agreements, related amendments, and other legally binding agreements prior to execution.
  • Ensure that all statutory, regulatory, and constitutional requirements have been satisfactorily complied with and that all reviewed contracts contain legally enforceable standards for the quantity and quality of goods and services being purchased and for the contracts' measurables, deliverables, and outcomes.
  • Provide advice and technical assistance, including training, to internal customers, including providers and service line representatives, about the provider enrollment, application, and contracting process, including the negotiation of provider-payor agreements.
  • Oversee the ethics and conflicts of interest functions across DCT to advance the objectives of state agency policy, and resolve conflicts of interest that arise internally within the Agency as well as those that arise because of the Agency’s external business relationships.

Requirements

  • Juris Doctorate (J.D.) from an ABA accredited law school;
  • Current license and in good standing to practice law in Minnesota;
  • Four (4) years of experience as a practicing attorney providing legal advice and guidance in contract law.

Qualifications

  • Experience drafting, reviewing, negotiating, and interpreting agreements;
  • Experience developing contract templates, policies, or legal guidance;
  • Experience advising stakeholders and leadership on legal risks, ethical conduct, contract interpretation, and compliance with applicable federal and state laws and regulations;
  • Strong legal research, analytical, negotiation, and written advocacy skills.

Skills

  • Experience supporting hospitals, health systems, managed care organizations, government healthcare programs or healthcare technology organizations;
  • Experience in drafting, negotiating, and providing line staff and Senior Executives advice related to Requests for Proposals and Contracts under Minnesota state law;
  • Experience working with or detailed knowledge of the Minnesota Government Data Practices Act (MGDPA) and the Health Insurance Portability and Accountability Act (HIPAA);
  • Knowledge of Medical Assistance (Minnesota’s Medicaid program) and managed care organizations;
  • Experience reviewing and negotiating provider/payer agreements;
  • Experience advising on real property matters such as purchase agreements, easements and leases;
  • Experience advising on Minn. Stat.43A.38, Code of Ethics for Employees in the Executive Branch, and related policies.

Pay

$43.69 - $64.80 / hourly; $91,224 - $135,302 / annually
