Bankruptcy Attorney

About the role

Join the Division of Medi-Cal Fraud and Elder Abuse (DMFEA), the California Department of Justice’s fastest growing Division, as an experienced attorney with bankruptcy expertise. This role focuses on recovering millions of taxpayer dollars by investigating and litigating high-impact cases involving fraudulent schemes against the Medi-Cal program. Cases are primarily brought under the California False Claims Act (FCA) and may also involve federal FCA violations, often in collaboration with whistleblower attorneys, the US Department of Justice, and other state Attorney General offices.

The DMFEA Bankruptcy Attorney will manage their own caseload of FCA work while providing expertise and assistance on bankruptcy-related case developments, including creditor-side issues in Chapter 7, 11, and 13 proceedings under the United States Bankruptcy Code, as well as related adversary proceedings. The role also involves advising on bankruptcy considerations in pre-bankruptcy settlements and other related issues.

Responsibilities

• Independently develop strategic case plans and manage FCA investigations.
• Handle informal and formal document-intensive and data-driven discovery.
• Identify, interview, and evaluate witnesses.
• Perform legal research in health care fraud and FCA-related law.
• Guide Paralegals and Investigative Auditors.
• Analyze claims data and develop damage models.
• Communicate effectively orally and in writing.
• Coordinate enforcement efforts with multidisciplinary teams.
• Litigate state FCA violations and other violations of California’s Medi-Cal program.
• Provide bankruptcy practice expertise, including resolving emergent bankruptcy-related case developments.

Qualifications

This position may be filled at the Deputy Attorney General III or IV level, depending on experience:

• Deputy Attorney General III: Minimum of 5 years of legal experience.
• Deputy Attorney General IV: Minimum of 6+ years of legal experience.

Pay

• Deputy Attorney General III: $10,852.00 - $15,325.00 monthly. New to State candidates will be hired at $12,046 monthly.
• Deputy Attorney General IV: $11,993.00 - $16,096.00 monthly. New to State candidates will be hired at $13,313 monthly.

This position qualifies for a "Hire Above Minimum" (HAM) salary.

Schedule

• Permanent, full-time position.
• Monday-Friday work week.
• Hybrid telework arrangement.

Location

This position is located in the Division of Medi-Cal Fraud and Elder Abuse, Civil Section, and may be filled in Burbank or San Diego, California.

Effective July 1, 2025, state employees are subject to temporary wage reductions in exchange for Personal Leave Program (PLP) accruals. The impact varies by bargaining unit.
