Assistant United States Attorney (Civil Bankruptcy)

About the role

The United States Attorney's Office (USAO), Southern District of Florida (SDFL) is seeking experienced attorneys to handle litigation in Bankruptcy Courts in the Southern District of Florida. You will work with a team consisting of another full-time Bankruptcy Assistant United States Attorney (AUSA) and two full-time Bankruptcy paralegals to practice before all federal bankruptcy courts in this District.

The cases you will handle consist of creditor-side bankruptcy representation of other federal agencies, such as the Internal Revenue Service, the Small Business Administration, and the Department of Education, in Chapter 7, 11, and 13 proceedings under the United States Bankruptcy Code, and related adversary proceedings. You will be assigned cases to litigate from inception to completion as the sole attorney representing those federal agencies in bankruptcy court to preserve said agencies' claims to payment from the bankruptcy estate. Responsibilities will increase and assignments will become more complex as your training and experience progress.

Responsibilities

• Represent federal agencies in bankruptcy proceedings, including Chapter 7, 11, and 13 cases.
• Handle adversary proceedings related to bankruptcy cases.
• Litigate cases from inception to completion as the sole attorney for the assigned federal agency.
• Manage increasing responsibilities and more complex assignments as experience progresses.
• Travel within and outside the district as needed.

Requirements

• United States citizenship is required.
• J.D. degree and active membership in the bar (any U.S. jurisdiction).
• At least 1 year of post-J.D. legal or other relevant experience.
• Must reside in the district to which appointed or within 25 miles thereof (see 28 U.S.C. 545).
• Initial appointment is conditioned upon a satisfactory preemployment adjudication, including fingerprint, credit, and tax checks, as well as drug testing.
• Continued employment is subject to a favorable adjudication of a background investigation.
• If applicable, registration with the Selective Service System for male applicants born after December 31, 1959.
• Applicants should disclose any potential conflicts of interest, including representation of clients or adjudication of matters involving this office, or family members involved in such matters.

Qualifications

Required Qualifications:

• J.D. degree.
• Active member of the bar (any U.S. jurisdiction).
• At least 1 year of post-J.D. legal or other relevant experience.

• Passion for the ideals of the American republic and upholding the rule of law and the United States Constitution.

Pay

Assistant United States Attorney's pay is administratively determined based, in part, on the number of years of professional attorney experience. The range of basic pay is $124,649 to $197,100, which includes 24.67% locality pay.

Payment of a recruitment incentive up to $15,000 may be approved.
