The Office of the Federal Defender for the Eastern District of California represents indigent persons in federal criminal cases and related court matters under the Criminal Justice Act, 18 U.S.C. 3006A.

About the role

The Capital Habeas Unit (CHU) Assistant Federal Defender (AFD) position is a full-time permanent role focused on advocating for indigent prisoners sentenced to death. The CHU team values skilled collaboration, strategic litigation, compassionate representation, and unique approaches to issues affecting clients.

This position offers the option for full-time telework from anywhere in the United States, with in-office options available as needed. Frequent travel within California and to other states may be required, and the role may involve work on holidays, evenings, and weekends.

Responsibilities

• Represent death-sentenced prisoners in federal habeas corpus proceedings across California and multiple other states, including all stages of litigation and clemency.
• Work directly with clients, digest large case files, and develop litigation strategies.
• Draft pleadings, conduct evidentiary hearings, and present oral arguments.
• Collaborate with experts, witnesses, and teams of investigators, paralegals, assistant paralegals, and case experts.

The CHU is based in Sacramento, a diverse and welcoming city with a vibrant cultural scene, including festivals, art events, and community activism. Sacramento also hosts a dynamic LGBTQ+ community with city-wide pride celebrations.

The office is located near dining, entertainment, and outdoor attractions, with easy access to California’s beaches, wineries, and mountains.
