About the role

The DOT seeks an experienced attorney to work in the Advocate’s Office. Under general supervision, with wide latitude for independent judgment and action, the Attorney will:

Responsibilities

  • Evaluate disciplinary matters for legal sufficiency
  • Draft formal disciplinary charges
  • Prepare and review required documents and reciprocal discovery including audio and video tape evidence
  • Assist and/or participate in disciplinary investigations with the Investigative Unit as necessary
  • Represent the DOT during informal settlement negotiations
  • Conduct informal conferences at OATH
  • Prepare memoranda detailing evidence and recommended penalties
  • Conduct prosecution of disciplinary proceedings pursuant to labor contracts and/or Civil Service Law 75 including internal DOT disciplinary proceedings, OATH trials, grievance proceedings and arbitrations, Civil Service Commission disciplinary appeals and related civil litigation
  • Assist Investigative Staff in conducting disciplinary surveillances
  • Review and evaluate evidence
  • Conduct legal research, prepare legal memoranda and briefs
  • Investigate and prosecute fitness complaints pursuant to Civil Service Law 72
  • Perform related duties as assigned

Minimum Qualifications

  • Admission to the New York State Bar
  • Either:
    • One year of satisfactory United States legal experience subsequent to admission to any state bar; or
    • Six months of satisfactory service as an Agency Attorney Interne (30086)
  • Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment

Assignment Level Requirements

  • Assignment Level II: One year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment
  • Assignment Level III: Two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment

Preferred Skills

  • 5 or more years of litigation experience
  • Experience handling disciplinary cases
  • Excellent writing, communication, interpersonal, analytical, research, problem solving, multi-tasking and organizational skills

Pay

$92,525.00 – $136,593.00
