Senior Regulatory Counsel
Overview
Our client, a rapidly growing Chemical Distributor/Manufacturer, is seeking a Senior Regulatory Counsel with deep expertise in chemical regulatory law, OSHA, EHS regulations, and regulatory interpretation to support operations across multiple manufacturing facilities across the US. This role fills a critical gap between our experienced technical regulatory teams and our compliance organization by providing legal analysis, risk-based interpretation, and strategic guidance on complex regulatory frameworks.
Key Responsibilities
Chemical Regulatory & TSCA
Provide legal counsel on compliance with the Toxic Substances Control Act (TSCA) and related EPA regulations.
Review, interpret, and apply chemical regulations to product formulations, classifications, and manufacturing processes.
Support preparation and review of Safety Data Sheets (SDS) and Technical Data Sheets (TDS), ensuring legal accuracy and regulatory alignment.
Advise on chemical approvals, reporting requirements, and pre-manufacture notifications.
Counsel teams on chemical transportation, labeling, storage, and classification requirements.
EHS Regulatory Counsel
Interpret and advise on OSHA and EPA regulations affecting manufacturing facilities.
Provide legal counsel on compliance with global product stewardship regulations, including EU REACH, UK REACH, and RoHS requirements.
Support customer inquiries, certifications, declarations, and contractual commitments related to REACH, RoHS, and other global product compliance frameworks.
Support facility-level environmental, health, and safety compliance, including recordkeeping, reporting, inspections, and enforcement matters.
Provide legal interpretation for EHS regulatory questions where statutes, guidance, and case law require nuanced analysis.
Serve as counsel to the EHS, operations, and chemical regulatory teams.
Trade & Government Contract Compliance (Secondary Areas)
Advisory on chemical classification for trade purposes (import/export).
Guidance on government contracting compliance requirements as needed.
Partnership with trade compliance leadership, who manages day-to-day operations.
Cross-Functional Collaboration
Work closely with the Director of Chemical Regulatory Affairs, regulatory specialists, EHS leaders, and the VP of Ethics & Compliance.
Translate regulatory requirements into practical options for the business, highlighting risks and alternative approaches.
Provide training and guidance on regulatory interpretation and legal risk mitigation.
Qualifications
J.D. from an accredited law school; active bar membership.
5–12+ years of experience in chemical regulatory, environmental regulatory, or EHS law.
Expertise in TSCA, EPA regulations, OSHA requirements, and chemical product regulation.
Experience drafting or reviewing SDS/TDS strongly preferred.
Understanding of chemical classification, transportation requirements, and product stewardship.
Experience in manufacturing, chemical, industrial, or related industries preferred.
Bonus: Background in chemical engineering, chemistry, or technical chemical work.
Ability to interpret statutes and case law and provide nuanced, risk-based counsel.
Strong communication skills; ability to partner with technical teams and non-lawyer regulatory professionals.
