Senior Counsel, Healthcare & Privacy

About the Role

Mastercard is seeking an experienced attorney to provide comprehensive, end-to-end, strategic support to our global Commercial and New Payment Flows business, with a focus on the commercialization of new products and services supporting the payment needs of the healthcare industry. The role involves contract drafting and negotiation, product development, regulatory, privacy, and compliance assessments, risk analysis, and support for the development and distribution of commercial and new payment flow offerings in the healthcare vertical.

Responsibilities

• Act as a day-to-day advisor for sales clients by partnering with the business and legal specialists to deliver on strategy, including expanding Mastercard acceptance and securing Mastercard’s share with merchants, acquirers, prepaid program managers, issuers, and digital partners.
• Advise the business on a wide range of commercial and contractual matters, including legal and business risk assessment and analysis on diverse issues from new product constructs to commercial agreements.
• Collaborate with internal subject matter experts to holistically advise on products and relevant regulatory, compliance, privacy, and antitrust issues.
• Support the Commercial and New Payment Flows business development teams in product sales initiatives.
• Autonomously structure, draft, review, and negotiate complex customer agreements, identifying legal and business risks and recommending solutions.
• Engage in strategic relationships and partnership agreements with digital partners.
• Train and educate clients on processes, risks, changes in laws and regulations, and the regulatory landscape of different regions.
• Partner with regional compliance leads to ensure products and services comply with corporate policies, such as gifts and hospitality, anti-bribery, anti-corruption, and third-party onboarding.
• Identify process improvements and efficiencies; own and execute solutions to support transformation strategy and streamline processes.

Qualifications

• Qualified lawyer with a solid academic and training background, licensed to practice in the relevant jurisdiction.
• JD or equivalent from an accredited law school in the US.
• At least 7 years of experience as an attorney.
• 3+ years in the pharmaceutical, biotech, or healthcare industry, or at a law firm supporting those industries, including experience in privacy law and commercial/medical-related matters.
• Experience with health regulatory compliance strongly preferred.
• Experience reviewing and advising on external-facing marketing, user content, and user experiences.
• Complex transactional legal experience at a reputable law firm or as in-house counsel.

• Keen business insight and strong communication skills to interact confidently and effectively with internal clients, Mastercard customers, and law and policy colleagues, including senior management and executives.
• Strong drafting and negotiating skills with the ability to understand and simplify complex concepts, issues, and deal structures.
• A team player, willing to take on responsibilities and roles that support the team, department, region, and company.

• Purchase, New York: $177,000 - $283,000 USD
• Arlington, Virginia: $177,000 - $283,000 USD
• Miami, Florida: $154,000 - $246,000 USD
• O'Fallon, Missouri: $154,000 - $246,000 USD

In the US, the successful candidate will be offered a competitive base salary and may be eligible for an annual bonus or commissions depending on the role. The base salary offered may vary depending on multiple factors, including but not limited to location, job-related knowledge, skills, and experience.
