Main Responsibilities
- Provide practical, timely and high-quality legal advice to assigned clients.
- Work directly with warehousing and distribution operations leadership and retail division leadership and advise on all aspects of employment law for the workforce, including day-to-day advice, resolving pre-litigation disputes, internal investigations and administrative claims, including OSHA complaints, management of litigation, and other key regulatory, compliance and commercial matters.
- Provide advice and counsel to Human Resources, Labor Relations and Operations on all aspects of employment law;
- Analyze complex commercial/business concepts and identify relevant legal issues and related, real-world risk;
- Provide prompt, clear and practical legal analysis, advice and solutions;
- Aid the business in achieving its goals;
- Work collaboratively with Asset Protection, Human Resources, Management and Labor Relations to investigate and defend claims by current and former employees;
- Provide advice and counsel on employment discrimination, wage and hour, ADA, OSHA and other employment-related matters;
- Partner with regulatory counsel to ensure compliance with federal and state regulations including food safety, DOT compliance, liquor laws, and environmental laws;
- Work independently and effectively to solve a wide range of commercial and regulatory issues and provide legal guidance to minimize risk across warehousing and distribution operations;
- Key legal support for the Transportation team, including subject matter expertise on DOT and FMCSA regulations and practical compliance solutions;
- Counsel on liability issues related to damaged goods, theft, delays and breach of contract;
- Develop and deliver training on legal issues and mitigating regulatory and employment risks;
- Represent the company in matters before federal, state and local administrative agencies;
- Manage outside counsel handling employment related lawsuits and regulatory matters as applicable;
- Respond to attorney demand letters and customer complaints, negotiate early resolution of disputes;
- Facilitate communication between the Legal Department and divisions/distribution centers.
Requirements
- Minimum of 8 plus years in private practice and/or in-house legal department experience in relevant areas.
- Substantive knowledge of employment laws and regulations, administrative procedures, court rules and legal research skills in order to effectively defend the Company.
- Strong negotiation, decision making, interviewing, investigation, and problem-solving skills.
- Good judgment, collaboration, interpersonal and communication skills.
- Ability to work independently and exercise excellent judgement and discretion.
- Demonstrated ability to translate legal requirements into practical, scalable solutions for the operations team.
- Excellent oral and written communication skills, collaboration and stakeholder management skills.
- Travel will be required to support out of state clients as necessary.
Qualifications
- License to practice law and in good standing with the Bar of any state that enables admission to practice as in house counsel.
