About the Role
Senior Counsel serves as an in-house contracts attorney specializing in the health care field, addressing contracts, laws, and regulations pertinent to the industry.
Responsibilities
- Provide practical and wide-ranging legal advice on issues affecting the organization.
- Review contracts and renewals related to physicians, suppliers, independent contractors, and other stakeholders.
- Conduct legal research on healthcare and business-related issues.
- Offer accurate, relevant, and timely advice to leadership and staff on legal topics impacting the business and its services.
- Draft, review, and negotiate various commercial contracts and agreements.
- Manage and mitigate legal risks by designing and implementing company policies and procedures.
- Ensure compliance with all applicable laws and regulations.
- Promote legal, compliance, and risk management best practices across the company.
- Communicate with and manage third-party bodies such as external counsel or auditors.
- Design and deliver legal training to the business.
- Stay current with legislative changes, particularly those affecting healthcare laws, rules, and regulations.
- Liaise with senior staff members.
- Assist in managing outside counsel on litigation or risk-related matters.
- Coordinate with the Regulatory Department on compliance initiatives.
- Foster a team atmosphere through respect, honesty, and direct communication.
- Support organizational change and promote departmental and company-wide goals.
- Maintain and uphold department policies and procedures.
- Oversee the work of junior attorneys or paralegal staff.
- Participate in in-services, seminars, and meetings to enhance awareness of Joint Commission and regulatory compliance.
- Engage in committees, Rogers Operating System (ROS) team meetings, and team projects as directed.
- Demonstrate punctuality, preparedness, effective communication, and organizational skills.
- Contribute positively to discussions and improvement activities.
- Attend department meetings and actively participate in ROS initiatives.
- Conduct yourself professionally and communicate positively with all individuals.
- Resolve issues with peers in a calm, solution-focused manner.
- Attend external seminars and educational classes for professional growth and continuing education.
- Comply with all Rogers Behavioral Health policies, including HR, Infection Control, and Employee Health.
- Project a professional image through appropriate attire.
- Perform other duties as assigned.
Requirements
Physical and Mental Demands
- Position requires walking, sitting, and standing.
- Moderate lifting capability (minimum 40 pounds).
- Reaching, handling, grasping, and manual dexterity for operating equipment.
- Verbal and hearing abilities for interacting with staff, consultants, patients, and family members.
- Numerical ability for record-keeping and computer operation.
- Tact and discretion for effective interaction with employees and professional staff.
- Logical thinking and decision-making for policy and procedure implementation.
- Ability to read, write, and communicate effectively through verbal and written skills.
- Physical and mental capability to perform job duties, verified by a post-employment physical exam.
Education and Training
- Bachelor’s Degree and Juris Doctorate required.
- Current state law license.
- 7 to 10 years of healthcare law experience, including physician contracting.
- Superior academic credentials and 3+ years of corporate, regulatory, or transactional experience in a law firm setting, with representation of healthcare organizations.
- Solid knowledge of HIPAA, Affordable Care Act, Medicare, Medicaid, Stark Law, False Claims Act, and Federal Anti-Kickback Statute.
