Key Responsibilities
- Manage litigation and claims involving bodily injury, property damage, negligence, nuisance, and related liability matters.
- Investigate incidents and advise internal stakeholders regarding potential legal exposure and appropriate response strategies.
- Partner with Risk, Safety, and Operations teams to develop proactive risk mitigation strategies.
- Work with insurance carriers, third-party administrators, claims adjusters, and brokers on coverage and claims matters.
- Advise on insurance coverage, indemnification obligations, hold harmless provisions, and contractual risk allocation.
- Manage outside counsel, litigation strategy, budgets, reserves, settlements, mediations, depositions, and trials.
- Provide legal guidance regarding OSHA investigations, citations, corrective action plans, and workplace safety matters.
- Support compliance with DOT regulations and drug and alcohol testing requirements.
- Draft and review policies, procedures, training materials, and regulatory compliance programs.
- Monitor regulatory developments and advise leadership on emerging legal and operational risks.
- Prepare legal updates and recommendations for senior leadership and other key stakeholders.
- Deliver training to managers and field personnel on risk, safety, claims, and compliance topics.
Qualifications
- Juris Doctor degree from an accredited law school.
- Active license to practice law and in good standing.
- 7+ years of legal experience focused on litigation, claims, insurance, risk management, safety, or regulatory compliance.
- Significant experience managing bodily injury, property damage, negligence, and related liability claims.
- Prior in-house experience or experience supporting a large, multi-state organization strongly preferred.
- Strong understanding of insurance coverage, indemnity, contractual risk transfer, and hold harmless provisions.
- Experience managing outside counsel, litigation budgets, reserves, and settlement strategy.
- Familiarity with OSHA regulations and workplace safety matters.
- Experience working within transportation, environmental services, industrial services, infrastructure, or another regulated industry is highly desirable.
- Knowledge of DOT regulations and drug and alcohol testing programs is a plus.
- Ability to provide practical legal advice to business leaders and operational teams.
