Public Defender
Job Overview
The Public Defenders serve as defense attorneys for indigent clients and those entitled by law to assistance of counsel in criminal and civil cases. They represent clients in court, prepare legal documents, interpret laws, and provide legal advice.
Essential Functions (Major Duties or Responsibilities)
Client Representation (95%): Represents clients in court, conducts hearings, and prepares legal documents. Provides legal defense in high-profile cases, reviews and prepares legal documents, and assists in trials and hearings.
Other duties as assigned (5%): Serves as a principal legal advisor in specific fields of law, attends continuing education trainings, and provides office support as needed.
Physical and Environmental Demands
This position involves working in various settings such as offices, courts, jails, detention centers, and mental health facilities. Workloads may fluctuate, requiring more than 40 hours per week and occasional exposure to stressful situations. Travel to attend court, trainings, and provide services to clients is common, potentially up to 40% of the time.
Knowledge, Skills and Abilities
Knowledge of legal and court policies, procedures, practices, and their application with particular reference to indigent defense.
Familiarity with criminal law and the law of criminal procedure in the State of Montana.
Continuing obligation to stay updated with changes and developments in the law through legal research and learning the agency endorsed legal research program.
Knowledge of state and federal laws, rules, and regulations and their judicial interpretation and precedents.
Ability to work effectively with marginalized populations and understand cultural differences affecting attorney-client relationships.
Strong organization, time management, and communication skills.
Ability to learn and utilize the agency case management system, establish and maintain effective relationships, and effectively research and analyze documents.
Minimum Qualifications (Education and Experience)
Juris Doctorate Degree from an accredited law school.
Membership in the State Bar of Montana.
Previous experience in criminal defense preferred.
