About the Role

Eight Sleep is seeking a versatile and experienced in-house counsel to join our legal team as the second lawyer, reporting to our first in-house legal counsel. This role is primarily focused on privacy and regulatory matters but requires a genuine generalist who can handle a wide range of legal issues, from commercial contracts to litigation support. As a key member of a small but growing legal function, you’ll have the opportunity to build programs and processes from the ground up, working in a fast-paced, innovative environment.

Responsibilities

  • Privacy and Data Protection:
    • Build and manage our global privacy program across frameworks like CCPA/CPRA, GDPR, and others, including disclosures, consent, records of processing, and data subject requests.
    • Handle data processing agreements, cross-border transfer compliance, and breach response playbooks.
    • Ensure compliance for biometric and health data, and conduct privacy reviews for new features, integrations, and AI models.
  • Regulatory and Consumer Protection:
    • Manage FTC and consumer protection matters, including health and wellness claims, advertising review, and subscription compliance.
    • Ensure compliance with market-specific requirements for product launches, including registration, import, labeling, and disclosures.
    • Track medical device and healthcare regulatory issues, and help navigate legal pathways for new product categories (FDA classification, corporate practice of medicine, anti-kickback, HIPAA).
  • Beyond Privacy and Regulatory:
    • Take on diverse legal matters as needed, including commercial contracts, litigation support, and product counseling.
    • Act as embedded counsel to product and engineering teams, and contribute to building out the legal function and operations.

Required Qualifications

  • JD and active bar membership in at least one US state.
  • 8 to 12 years of relevant experience, with significant in-house experience.
  • Solid working knowledge of US privacy laws (CCPA/CPRA), GDPR, and FTC/consumer protection regulations.
  • Proven ability to work as a versatile generalist, comfortable handling unfamiliar matters independently.
  • Self-starter with a strong work ethic, capable of making decisions and advising the business directly.
  • Comfortable in a fast-paced, build-oriented environment.

Preferred Qualifications

  • In-house experience at a consumer technology, healthtech, wearable, or DTC subscription company.
  • Experience as a first or early regulatory or privacy hire.
  • Familiarity with biometric or health data, cross-border data transfers, and data localization.
  • Experience with advertising, health claims, or healthcare regulatory matters (HIPAA, corporate practice of medicine, FDA/FTC intersection).
  • Knowledge of AI governance and emerging AI regulation.
  • CIPP/US or CIPP/E certification is a plus, though experience is prioritized over credentials.
