Effective January 1, 2021 (for employers with 16 or more employees) and January 1, 2022 (for all other covered employers), Colorado’s Healthy Family and Workplaces Act requires accrual of at least one hour of paid sick leave for every 30 hours worked, up to 48 hours total.

About the law

  • Applies to hourly, salaried, exempt, non-exempt, and seasonal employees.
  • Leave may be used immediately for:
    • Personal illness or medical appointments (including well visits).
    • Care for family members.
    • Leave related to domestic abuse or sexual assault.
    • Mental-health needs.
  • Limited notice and documentation requirements for leave requests.
  • Prohibits retaliation, pay reduction, or discipline for requesting or taking sick leave.
  • Requires posted notices and specific record-keeping.
  • No payout of accrued, unused sick leave upon separation.
  • Rehire provision: employees who separate and are later rehired must be credited with the bank of hours they had upon separation.

Implementation

Our software system is fully equipped to handle the paid-sick-leave mandate and has been doing so for clients in states with similar requirements. InTANDEM HR will reach out to smaller clients to ensure compliance.
