General Description

The Office of the Attorney General is seeking attorneys licensed in Texas to join the agency’s Healthcare Program Enforcement Division. This division engages in the exciting and fulfilling work of investigating, evaluating, and litigating whistleblower lawsuits under the Texas Health Care Program Fraud Prevention Act. Cases involve pharmaceutical companies, drug manufacturers, and medical providers.

Essential Position Functions

  • Initiates and conducts Healthcare Program Enforcement and related investigations.
  • Analyzes factual and legal issues and develops evidence for pursuit of Healthcare Program Enforcement cases, including legal research, interviews, and investigator activity.
  • Reviews data and documentation from client agencies and other resources, coordinates with the federal government, and evaluates potential resolutions of whistle-blower lawsuits.
  • Maintains oversight of pending cases where the State has declined intervention, preparing legal briefs independently and coordinating with other AAGs.
  • Works on a team to investigate and litigate complex cases, preparing cases for jury trial, conducting pre-trial litigation, and managing discovery.
  • Prepares legal briefs, pleadings, and other legal documents; drafts discovery requests and responses; represents the Office of the Attorney General in state and federal court proceedings.
  • Oversees the analysis of factual and legal issues and develops evidence through witness interviews, depositions, and other discovery.

Qualifications

  • Minimum Qualifications:
    • Graduation from an accredited law school with a Juris Doctor degree (J.D.).
    • Two years of full-time experience as a licensed attorney.
    • Licensed as an attorney by the State of Texas and eligible to practice law in Texas by start date.
    • Excellent oral and written communication skills.
    • Ability to handle multiple tasks, prioritize, and meet deadlines.
    • Sound judgment and effective decision-making ability.
    • Knowledge of law, legal principles, and practices relevant to the Texas Healthcare Program Fraud Prevention Act and False Claims Act.
    • Experience working on complex civil litigation in both state and federal courts.
    • Familiarity with Texas and Federal case law regarding discovery and pleading.
  • Preferred Qualifications:
    • One additional year of full-time experience as a licensed attorney.
    • Working on complex civil litigation in both state and federal courts.
    • Summation, Concordance, Relativity or Clearwell legal review software experience.
    • Experience conducting legal analysis involving complex statutory and regulatory schemes at the state and federal levels.
    • Knowledge of Texas Rules of Civil procedure, Texas Rules of Evidence, Federal Rules of Procedure, and Federal Rules of Evidence.
    • Familiarity with Texas and Federal case law regarding discovery and pleading.
