About the role
The Office of the Attorney General (OAG) seeks an experienced attorney to join the Administrative Law Division (ALD). ALD represents dozens of state agencies in court, managing their own dockets as first chair. Ideal candidates have experience in administrative law or are willing to learn and represent state agencies in state and federal courts.
Responsibilities
- Represents state agencies in state and federal district and appellate courts in matters involving judicial review of agency orders, enforcement proceedings, and challenges to agency rules and statutes.
- May represent the OAG and state agencies in open records litigation, assist state agencies in responding to non-party subpoenas, and provide general counsel assistance.
- Handles administrative enforcement proceedings before the State Office of Administrative Hearings.
- Drafts pleadings, motions, briefs, and discovery; participates in trial and appellate advocacy.
- Analyzes routine factual and legal issues; performs legal research; coordinates, plans, and monitors legal activities; provides legal advice, counsel, and assistance; independently manages a diverse litigation docket with moderate supervision.
Requirements
- One year of full-time experience working as a licensed attorney.
- Licensed as an attorney by the State Bar of Texas and eligible to practice law in Texas by start date.
- Knowledge of legal principles, practices, and proceedings; state and federal laws, regulations, and rules relevant to administrative law.
- Experience in legal research, writing, and analysis; investigations; mediation and negotiations; reasoning and logic; identifying and solving complex problems; prioritizing workloads; exercising sound judgment and effective decision making.
- Ability to prepare legal documents, conduct research, interpret and apply laws, summarize findings, prepare cases for trial, conduct hearings, and communicate effectively.
- Ability to receive and respond positively to constructive feedback; work cooperatively with others in a professional office environment; provide excellent customer service; arrange for personal transportation for business-related travel; work more than 40 hours as needed and in compliance with the FLSA; lift and relocate 30 lbs.; travel (including overnight travel) up to 20%.
Qualifications
- Education: Graduation from an accredited law school with a J.D.
- Experience: One year of full-time experience working as a licensed attorney.
- Licensed as an attorney by the State Bar of Texas and eligible to practice law in Texas by start date.
- Knowledge of legal principles, practices, and proceedings; state and federal laws, regulations, and rules relevant to administrative law.
- Experience or equivalent including appellate and brief writing experience.
- Experience in administrative law.
- Experience in interpreting and applying open records, open meetings, and other open government legislation.
- Admitted to practice in Federal District Courts.
