National Legal Consultant (SSAs) (deadline extension)
Objective
The objective of the assignment is to serve as a national legal consultant on the development of a bylaw governing the rules for the preparation, execution of investment agreements, in close cooperation with the relevant department(s) of the SCISPM.
Tasks and Responsibilities
Developing a workplan and methodology for the implementation of the assignment;
Getting familiarized with the current legal background of the investment policy in the Republic of Tajikistan along with the strategies by arranging meetings with the SCISPM and its subordinate state institutions to co-ordinate her/his further actions;
Assessing the legal status of the current investment agreements and identifying hurdles in their proper and timely execution;
Developing a list of proposed mechanisms for monitoring and control over the implementation of investment agreements;
Proposing tools for harmonization of national practices with international standards (OECD, UNCTAD, IFC);
Suggesting mechanisms on ensuring the coordination of actions of government bodies, as well as regulating the powers of government bodies;
Suggesting mechanisms on improving the government control procedures and introducing risk-oriented approaches;
Developing mechanisms on increasing the transparency of public administration and public procurement processes while executing an investment agreement;
Preparing draft of the bylaw and presenting it to SCICPM and POiD for review;
Revising the draft based on comments received from SCISPM, POiD and other stakeholders;
Finalizing the bylaw and supporting documents.
Necessary Qualifications
University degree in law, economics, business administration, commerce, finance or in another related field;
Minimum 5 years of proven professional experience in the field of legal advisory, investment, trade, finance and commerce and/or export;
Professional experience of working with legal authorities or inter-governmental trade organizations, business associations/committees;
Proven expertise in drafting legal documents supporting the implementation of strategic action plans and task force activities;
Knowledge of methods on assessing the risks supplemented in implementation of investment agreements;
Professional fluency in Tajik and Russian, knowledge of English, both spoken and written would be considered as an advantage;
Demonstrated gender awareness and sensitivity, and an ability to integrate a gender perspective into tasks and activities;
Ability and willingness to work as a member of team, with people of different cultural, and religious backgrounds, different gender, and diverse political views, while maintaining impartiality and objectivity;
Computer literate with practical experience using Microsoft applications.
Remuneration Package
Remuneration will be based on the selected consultant's/expert's qualifications, experience, the tasks and deliverables for this position and in accordance with the OSCE established rates.
