Key Responsibilities
- Provide legal counsel and guidance to firm’s IP clients.
- Manage clients’ IP rights relative to trademarks, copyrights and trade secrets.
- Draft, review and negotiate IP-related agreements.
- Conduct IP due diligence for mergers, acquisitions, and other business transactions.
- Advise clients on U.S. and international trademark strategy, including brand selection, clearance, registration, maintenance, and enforcement.
- Conduct and analyze trademark clearance searches; assess risk and provide actionable recommendations to business clients.
- Prepare, file, and prosecute U.S. trademark applications before the USPTO, including responding to Office Actions and managing post-registration matters.
- Manage international trademark portfolios, including coordinating with foreign counsel on filings, renewals, and enforcement matters.
- Handle trademark opposition, cancellation, and enforcement matters before the TTAB, including drafting pleadings and managing discovery.
- Counsel clients on trademark use, licensing, coexistence agreements, and brand protection strategies.
- Advises clients on trade secret protection strategies.
- Advises clients on software licensing, development, and sale matters, and negotiate software license, reseller, development, and sale agreements.
Qualifications
- JD degree from an accredited law school.
- Active Virginia State Bar license.
- Five or more years of IP experience preferred.
- Detail-oriented, good communicator with strong writing and organizational skills.
- Material book of business or, alternatively, ability to also support commercial litigation cases.
