Starting Salary Range
The State Corporation Commission’s (Commission) Office of Hearing Examiners seeks an experienced attorney to conduct hearings on behalf of the Commission.
About the Role
Virginia Code Section 12.1-31 authorizes the Commission to assign, by written order, any matter pending before it to a hearing examiner. Unless otherwise ordered, the hearing examiner conducts all further proceedings in the matter on behalf of the Commission in accordance with the Commission’s rules. In the discharge of his or her duties, the hearing examiner exercises all the adjudicatory powers possessed by the Commission. Those powers include, but are not limited to, the power to require the production of documents; schedule and conduct pre-hearing conferences; admit or exclude evidence; and rule on motions, matters of law, and procedural questions. At the conclusion of all assigned duties, the hearing examiner issues a written final report and recommendation for disposition of the matter to the Commission. Any such recommendations are advisory only, and do not preclude the Commission from taking further evidence or action.
Responsibilities
- Conduct hearings in a fair, unbiased and professional manner
- Research and prepare complex rulings and reports to resolve issues of fact and law
- Develop recommendations based on the record developed in a case, and the applicable statutory and case law
- Express ideas clearly, both orally and in writing
- Establish and maintain professional and effective relationships with Commission staff, industry personnel, and the general public
Preferred Qualifications
- Extensive professional experience in regulatory and administrative law, preferably including some electric rate or facilities regulatory matters
- A law degree from an accredited law school
- Admission to the Virginia State Bar
- Knowledge of the Commission’s Rules of Practice and Procedure
- Strong public speaking and writing skills
- A professional and judicial demeanor
- Considerable knowledge of: the industries regulated by the Commission; statutory and case law pertinent to the regulatory jurisdiction of the Commission; regulatory responsibilities of the divisions of the Commission; and state and federal law and regulations pertaining to the activities of the Commission
