About the Role

This position involves addressing highly complex legal questions impacting the United States Army Corps of Engineers (USACE) missions. The role includes representing the agency in administrative litigation and providing legal counsel on workplace issues.

Responsibilities

• Identify, research, and address extremely complex and difficult legal questions affecting USACE missions.
• Represent the agency in administrative litigation, including matters before the Merit Systems Protection Board (MSPB), Equal Employment Opportunity Commission (EEOC), and Office of Special Counsel (OSC).
• Counsel management on workplace issues, including harassment, misconduct, whistleblower protections, and professional standards of conduct.
• Perform discovery, draft motions, prepare witnesses, and conduct hearings and appeals.

Requirements

• Appointment may be subject to a suitability or fitness determination, as determined by a completed background investigation.
• Must submit a Confidential Financial Disclosure Report (OGE450) upon entry and annually thereafter.
• Must maintain active bar membership in good standing of the bar of the highest court of a State, U.S. territory, the District of Columbia, or Commonwealth of Puerto Rico.
• U.S. citizenship is required.

Qualifications

To qualify, you must meet the following education and experience requirements:

• Successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and hold the first professional law degree (LL.B. or J.D.).
• Three or more years of professional legal experience acquired after being admitted to the bar, commensurate with the duties and responsibilities of the position. Graduation from an ABA-accredited law school in the top 25% of the class or an advanced law degree (e.g., LLM) may substitute for one year of the required experience.
• Professional legal experience includes:
  • Researching complex legal issues involving federal and state laws, regulations, and policies to provide authoritative legal guidance.
  • Preparing legal opinions, memoranda, contracts, and other legal instruments addressing complex or novel legal questions.
  • Representing the organization in negotiations, hearings, administrative litigation, and other legal proceedings.
  • Providing legal advice and interpreting federal, state, and local laws to support management decisions and policy development.
  • Conducting comprehensive legal research and developing legally sound recommendations for high-impact matters.
• Must currently be a member in good standing of the bar of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico.
• Must be fit to practice law. If fitness or conduct has ever been challenged, a notarized sworn statement detailing the circumstances must be submitted.
• If currently employed as an attorney by the Federal Government, must have completed 1 year at the next lower level within 30 days of the closing date or previously served at the same or higher grade.
