About the role
This regional ordinance regulates outdoor work during periods of high heat risk in Emilia-Romagna, effective from 3 June to 15 September 2026. It applies to workers in agriculture, floriculture, construction, logistics yards, quarries, and delivery riders using bicycles or e-bikes.
Responsibilities & Regulations
- Prohibits outdoor work between 12:30 and 16:00 in sectors exposed to prolonged sun during "high risk" days, unless safety measures are fully implemented.
- Extends the ban to quarries and delivery riders (including those using pedal-assisted bikes).
- Requires delivery platforms to adjust algorithms to account for heat risk in delivery time and distance calculations.
- Allows construction sites to start work one hour earlier to avoid peak heat, with temporary noise exemption from municipal regulations.
- Applies to all workers regardless of role, contract, or employment status when the INAIL Worklimate risk map indicates "high" risk for intense physical activity under sun exposure.
- Mandates employers to adopt organizational measures to safeguard essential public services and emergency interventions.
Compliance & Enforcement
Non-compliance with the ordinance may result in legal penalties under Article 650 of the Italian Penal Code. The ordinance will be published on the Emilia-Romagna regional website and communicated to prefects, mayors, health authorities, unions, employers, and industry associations.
