This position enforces RTD’s Disadvantaged Business Enterprise (DBE) and Small Business Enterprise (SBE) programs in accordance with U.S. Department of Transportation (DOT) Regulations, including 49 CFR Part 26. This position enforces compliance and monitors projects to ensure DBE/SBE participation in RTD projects as well as contracts under RTD’s subrecipient municipality agreements and assess projects for small and disadvantaged business participation goals. This position also monitors and enforces compliance requirements on federally funded projects through certified payroll audits and labor interviews. Serves as the subject matter expert (SME) for the DBE and SBE programs and represents RTD at outreach events to promote participation by small and local businesses. Essential Duties & Responsibilities: Competency Analyzes and assigns RTD & Subrecipient Municipality agreements, projects, and contract requisitions for DBE/SBE goals, including evaluating scope of work, identifying firms that can perform based on the specific task, assigning appropriate North American Industry Classification System (NAICS) codes, researching available DBE/SBE firms, and completing the goal computation and analysis according to Federal and State regulations.Represents RTD as a SME in outreach and engagement activities, supporting DBE/SBE programs and small business participation. Conducts and participates in presentations, panel discussions, workshops, trade shows, and other outreach efforts to communicate contracting opportunities, training resources, and regulatory requirements in collaboration with community organizations, chambers of commerce, industry groups, and public agencies.Compiles data to support RTD’s Federal Triennial DBE Goals for submission to the U.S. DOT Federal Transit Administration (FTA).Delivers internal training on DBE and SBE program regulatory and compliance requirements for RTD Project managers and other internal stakeholders.Facilitates project meetings with DBESBE goals, including pre-awarded, kick off, ongoing, and project close out meetings.Serves as the primary point of contact for RTD’s Project Managers, Contracting and Procurement Agents, Awarded Primes Project Managers, business owners, and assigned community organizations and chambers of commerce, ensuring program adherence.Compiles DBE compliance data on federal assisted contracts and submits reports for the FTA Semiannual Uniform Report of Awarded Contracts, ongoing DBE payments, and Project Closings.Prepares and maintains documentation and reports for the FTA Triennial Reviews, including files related to prompt payment issues, contract termination, substitution, replacement, or reduction, Commercially Useful Functions (CUFs), site visit reviews, and outreach efforts.Provides DBE/SBE compliance oversight throughout the procurement process by presenting regulatory requirements at pre-bit, proposal, and qualification meetings; evaluating contractors’ Good Faith Efforts; reviewing bids, proposals, statements of qualifications, and contract documents; conducting responsiveness reviews; and approving contracts with established DBE/SBE goals prior to solicitation.Creates, maintains, and analyzes monthly DBE/SBE participation, Commercially Useful Function (CUF), payment, audit, meeting, and Prime contractor/subcontractor reporting to monitor compliance and support program administration.Monitors contracts and associated compliance data to ensure adherence to DBE/SBE participation requirements, including 49 CFR Part 26. Reviews contractor reporting through compliance systems; monitors goal attainment, prompt payments, retention payments, contract closeout activities, CUF requirements, and requests for termination, substitution, replacement, or reduction of certified firm participation.Monitors and ensures compliance with the Davis-Bacon Act, Federal Regulation 29 CFR Part 5, and RTD labor compliance requirements. Conducts employee field interviews, investigates related labor-related issues, facilitates conflict resolution, analyzes interview reports, and monitors wage compliance and prompt payment on federally funded projects.Investigates and enforces corrective actions on DBE/SBE program contracts as well as Davis-Bacon Act violations, to include written reports and accurately reporting actual and potential violations to enforcement agencies. Qualifications Required Qualification: Bachelor’s degree in Business Administration, Public Administration, Finance, Accounting, Engineering, or related field. A minimum of three (3) years of experience working in contract compliance, DBE/SBE Certification Programs, or related DBE/SBE or regulatory compliance programs. Ability to work outside of typical business hours, as needed, for RTD-related outreach events. Preferred Qualifications Experience administering or monitoring DBE and/or SBE programs.Prior experience working in a public sector, transit, or highly regulated environment. OR An equivalent combination of education, experience, knowledge, skills, abilities. Key Competencies & Characteristics Knowledge of federal, state and local laws and regulations pertaining to minority/women business enterprise, small business development and procurement programs.Knowledge of Davis-Bacon compliance.Knowledge of contractual policies, practices, procedures and terminology.Knowledge of applicable governmental procurement policies, procedures, and legal requirements; along with tax laws, business structures, and financial analyses.Proficiency in Microsoft Office Suite with intermediate skill level in Excel.Ability to use sound judgment and maintain strict confidentiality.Strong written and verbal communication skills, including the ability to communicate specialized information effectively to diverse audiences.Strong presentation skills, including the ability to prepare and deliver presentations and facilitate community outreach events.Strong customer service skills, including the ability to effectively respond to inquiries, maintain positive working relationships, and provide support to RTD teams, business partners, and community members.Ability to establish and maintain effective working relationships with employees, management, contractors, business owners, community organizations, and members of the public.Ability to manage time and workload effectively, including planning, organizing, and prioritizing with attention to detail.
