Assistant General Counsel - Hospital Services

About the Role

The Assistant General Counsel – Hospital Services represents MHS and its wholly owned affiliates and operating divisions, leading and implementing legal strategies for system-wide hospital operations. This role partners strategically with leaders across the system, including hospital operations, revenue cycle, care management, health information management, litigation support, medical staff services, pharmacy, marketing, and supply chain.

Responsibilities

• Work under the direction of the Chief Legal Officer, reporting directly to them.
• Serve as a strategic leader for the Office of Legal Affairs, directing contract administration for system operations and supply chain.
• Provide lead counsel on:
  • Hospital operations and patient care
  • Referral source agreements and fair market value (FMV) matters
  • System contract administration
  • Revenue cycle, payment, and billing issues
  • Regulatory matters and regulatory litigation
  • Governmental investigations
  • Policy support
  • Pharmacy
• Offer accurate and timely legal advice on state-specific healthcare laws, Medicare/Medicaid rules, fraud and abuse (Stark, anti-kickback), patient rights, quality of care, informed consent, and billing/reimbursement.
• Act as the Office of Legal Affairs liaison to the System Quality Review Committee (a board committee) and other committees, congresses, and task forces.
• Undertake other duties as assigned.

Requirements

• Full technical proficiency in representing hospital management and counseling senior leadership on hospital operations and physician relationships.
• Experience leading strategic, complex projects and innovating legal concepts related to hospital operations.
• Outstanding analytical, negotiating, and drafting abilities.
• Pragmatic business acumen with the ability to recognize broader implications of legal advice.
• Demonstrated excellence in oral and written communication.
• Innovative thinking to add value and find creative solutions to complex legal issues.
• Strong interpersonal skills for successful interaction with diverse colleagues, clients, and leaders.
• Ability to manage multiple tasks, prioritize, and work independently in a high-performing, collegial environment.

Qualifications

• Extensive knowledge of federal and state healthcare laws, including Medicare/Medicaid reimbursement, HIPAA, anti-kickback statutes (AKS), self-referral prohibitions, and fraud and abuse.
• Excellent working knowledge of operational and strategic issues affecting hospitals, health systems, providers, and integrated delivery systems.
